Newyork gennessee county permit upgrade

I have a friend who lives in gennessee county in new york state and he has a NYS pistol permit for about 15yrs for hunting and target and wants to upgrade it to an unlimited carry permit.

He has been told that the issueing judge feels that no one should have a pistol permit at all and he often denies full carry permits.

So do any have you have advice on what to put down for a valid reason for an upgrade to unlimited carry.

Please be real in your responses, stating its your constitutional right doesn't carry any weight with a new york judge.

The New York permit system was created in 1911 because the criminals were getting shot at. Senator Timothy Sullivan drafted the law in order to protect his source of income from the criminal gangs that he controlled by disarming their victims.

Your friends best bet would be to try to be the next Heller or McDonald.

As was stated before, why? "For any and all lawful purposes" sounds good to me.

What I was going to say (and this only works if there is more than one judge that grants these hearings) do what the lawyers do...shop the judge. Check to see which (if any) of the possible judges is most sympathic to carry. Then file in such a manner that his petition is heard by that judge. (if that is possible)

If you have a suit and you want a leg up, your lawyer (if he is any good) will watch the rotation, and file when the judge he wants to hear the case (because he would expect the most favorible outcome because of that judges sympathies) is next in line to get a case. At least that is how it works where I live.

If you have ever heard of the Judge George Bolt decision on Native fishing rights out here in WA,,,,well that is exactly how that was done.
 
I'm a New York permit holder too, and I got lucky with my judge. I asked for "all lawful purposes," and I got it: unrestricted. He retired not long after, and the new judges all put restrictions on. Some of them will lift them eventually, and some won't. The ones that will upgrade permits usually want to see proof of some kind of training.

When you say "the issuing judge," do you mean the guy who gave him his first permit 15 years ago? Either shop a new judge or wait him out. He has to retire someday. Of course, the new one could be worse.
 
Toivo! You are an example of just what I am talking about. I am sure there are some judges that are sympathetic to carry, and some that are absolutely against it.

Not knowing the county, I can't say anything, but I would assume there is more than one judge that can approve a permit, in which case you want to make sure your hearing is before the most sympathetic judge...if at all possible.

I could find out you if teh applicant was in Sullivan Co, New York, which judge might be more sympathetic, but that is only because my SIL is the county prosecutor.

There is another possibility. Obtain a piece of vacation property in one of the rural counties with more sympathetic judges, and apply there.
