Boy, 11, shoots rifle to scare off teen intruders

October 7, 2003, 12:56 PM EDT

PHELPS, N.Y. -- An 11-year-old boy fired a rifle several times to scare
off two older boys who kept ringing the doorbell.

The boy went to the door and ordered the teens, ages 13 and 14, to go
away, but they refused and then entered the home's adjoining garage in
this rural western New York town, the sheriff's office said.

When the teens refused orders to leave, the boy went into the house,
reappeared with a .22-caliber rifle and fired several shots outside the
garage door, authorities said. The bullets passed within five feet of
the teens, who were not hurt.

The boy, who was not identified, could be charged with reckless
endangerment, the sheriff's office said in Tuesday's Daily Messenger of
Canandaigua.

How could this child, the 11 y.o., be charged with reckless endangerment? He was firing at 2 yoots who were trespassing and had been ordered to LEAVE.
Well, darnit! guess that's gonna be the affirmative defense. If his parents need help with legal expenses I'll send a check. Keep us updated.
And good on the kiddo, just needs to keep practicing.

Reckless?...in what way?...were his eyes closed? He got his point across very well. I think the two tresspassers should be picked up and let their parents hire a lawyer. Then they could explain to a judge why they provoked the 11 yr old to fire those shots.
Mark.
