Hello ...... New to this forum but wanted to get clarification on the SAFE act. I have read many posts on AR15.com, other blogs, and here as well where it has been conveyed that a semiautomatic rifle with a detachable magazine is allowed one evil feature which could be a folding/telescoping stock, flash hider/muzzle brake, pistol grip, etc. Some have said that if you have an AR with a pinned stock, pinned muzzle brake, then a pistol grip is permissible. Some have said that flash hiders are illegal while muzzle brakes are not. If you look at a carbine like the Berretta CX4 with a fixed stock, no threaded barrel, and a thumb hole grip, many have said that it is legal in Ny. But I am confused.

When I went to the Safe Act site and went through their interactive program to determine what a assault weapon is, it seems pretty clear. If you have a detachable magazine rifle, all muzzle brakes and flash hiders are illegal weather pinned or not. Pistol grips, thumb hole grips, telescoping/folding stocks, threaded barrels are all illegal as well. If you have a detachable magazine in a semiauto, according to the site, my interpretation is everything is illegal. Preban high capacity mags are also illegal but to a lesser extent than current high capacity mags. Am I missing something here? While many say the CX4 is legal in Ny, it appears that it is not.

Now, if your current gun has any or more of the above features and was purchased before 4/15/14, you can use it in NY as long as it is registered. But it will become the property of the state when you die unless you sell it prior to your death or when the communist NYS government enacts a confiscation program.

What am I missing here? Is my interpretation of the safe act correct? Am I missing some fine print somewhere or any admendments to the law? Would a CX4 style carbine be legal in NY? Thanks in advance for your insight and help.

To answer your question I believe the CX4 is illegal in NYS, if bought new. I have a friend who still lives in communist NY and he had to register his CX4 or get it out of the state. He hates registration as much as the next guy, so he has it stored out of state to avoid that and having an "unregistered assault weapon."
 
Yes it is considered an assault rifle. A semi cannot have a pistol grip, thumbhole stock, muzzle attachment, forward hand grip, bayonet lug, and a few other things if the rifle has a removable mag. Permanently plug the mag well and your good to go. And by permanently they mean it.

Now where it gets really weird, is that with a FIVE-round magazine a rifle is allowed to have a muzzle break, but nothing else.

A manually operated firearm. If it's a semi auto capable of excepting a larger cap mag It has to be registered unless the mag is fixed. Basically if you have a semi auto with removable mag it can have no other features. The removable mag is the 1 feature.

The SAFE act it full of pitfalls. If you read one section it is vague so you need to read another section to get all the info. One thing I never hear talked about is the backdoor gun confiscation. If you have a unregistered AW it's a misdemeanor/ But a mag over 10 rounds is a Class D Felony. So you can lose you rights to own any firearms by having a mag. But not the actual gun. How many shooters that had multiple hicap mags may have one in a range bag, car trunk, or other area they may have forgot about when they got rid of them. Another new rule. If your pistol permit isn't renewed for any reason or gets revoked you lose ALL your guns. Before you only had to get rid of the handguns.
