Ohio Supreme Court upholds Pre-emption of city gun laws

The Ohio Supreme Court ruled on the Appeals Court case filed by Cleveland Vs the State of Ohio challenging RC 9.68, which pre-empts local gun laws in favor of statewide laws.

Some cities such as Cleveland have long had laws on their books making certain guns and magazines illegal. When Ohio passed 9.68 the city of Cleveland, among other cities, vowed to fight to be allowed to ban guns. Cleveland maintained a registry of handguns and banned so-called "assault weapons" outright. This decision, cluminating years of work, finally drives the nail in the coffin of overly-restrictive local gun laws.

We hold that R.C. 9.68 is a general law that displaces municipal firearm
ordinances and does not unconstitutionally infringe on municipal home rule
authority.

The Ohio Supreme Court today dealt a fatal blow to local efforts to regulate firearms, concluding that a more permissive state law should trump restrictions on guns in cities.

That was indeed good news, however, according to the local news, city of Cleveland Mayor, Frank Jackson has vowed to appeal the decision. Apparently, he just doesn't get it. It was his appeal to the state supreme court that brought down this decision. Now he doesn't like it because they did not agree with him, so he will spend more tax payer money in another effort to overturn state law. He is having trouble comprehending that he is not all powerful in the state of Ohio.
 
the fight will never be over. there will allways be someplace that will restrict some type of firearm. lets hope the mayor of cleveland will give up.
