Charges not filed in shooting
NEWKIRK -- Prosecutors will not file charges against a rural Kay County man who shot and killed another man last month.
District Attorney Mark Gibson said Thursday that Kenneth Nance was defending himself at his home Dec. 1 when he shot Lunden Shane Miller of Ponca City.
State law allows the occupant of a home to use deadly force against a person who has made unlawful entry into that home, a release from Gibson states.
Miller had threatened Nance and his family and had gone to Nance's home for that purpose, Gibson said in the release. Nance shot Miller after repeatedly asking him to leave and being injured himself.
