8/17/05 State's Attorney Determining Charges in Wamac Shooting
Marion County State's Attorney Matt Wilzbach says he has not yet decided what charges will be filed in connection with a Monday night shooting in Wamac.
Wamac Police say 76-year-old Roy Miller of Kent Street in Wamac shot at 19-year-old James Matt Evilsizer of Wamac seven times with a 22-caliber pistol, hitting him in the leg and abdomen. Miller allegedly fired the shots after Evilsizer beat on Miller's garage door and van, damaged his satellite dish, and then pounded on Miller's porch and front door.
After the shooting, police say Evilsizer went to a home in the 600 block of Wabash where he struck an unidentified man with a board.
When police pulled up, Evilsizer allegedly rushed the squad car and beat on the passenger window. Evilsizer eventually ran away and was approached on James Street by three Centralia Police officers who responded. Evilsizer allegedly took off his belt and told police to 'come get me'. Police say Evilsizer was eventually handcuffed after being pepper sprayed.
He then allegedly fought with ambulance personnel while being taken to St. Mary's/Good Samaritan Hospital in Centralia for treatment. Once at the hospital, police say Evilsizer was administered drugs to calm him down.
Wilzbach says tests showed Evilsizer had a blood alcohol level more than three times legal intoxication, and had methamphetamine and cannabis in his blood stream. Evilsizer has been admitted to the hospital for treatment.
Wilzbach says no charges will be filed pending further investigation into the actions of both Miller and Evilsizer.
