OKLAHOMA CITY (AP) - An Oklahoma City pharmacist who shot and killed a 16-year-old would-be robber was charged today with first-degree murder.

An affidavit says 57-year-old Jerome Ersland shot Antwun Parker on May 19 while Parker was incapacitated and lying on his back.

Ersland has said he opened fire in self-defense.

Parker was shot once in the head and five times in the stomach area. An autopsy determined Parker was still alive after being shot in the head.

Ersland says two people in ski masks threatened him and two other employees at Reliable Discount Pharmacy and because he's disabled he couldn't run. Ersland says he took a pistol from his pocket and shot Parker in the head - then shot him five more times as the teenager tried to get up.

Well when you shoot a guy that is down......

Yes I understand that the guy was probably scared of the kid, but seriously.
 
If the guy was still moving he was still a threat. This is even more so if the shooter was disabled and unable to run.

The police empty their magazines in shootouts on a regular basis. I've never heard of any of them being charged.
 
There seems to be a lot more to the story than this news article shows. Seems the videotape from the store security camera didn't jive with the pharmacists story.

Shooting a wounded perp who is trying to get back up is one thing, lying about the circumstances is a whole other ball game.

I think that's what we are seeing here.

From another news story:

An affidavit written by Detective David Jacobson said Ersland's account doesn't match the video or the evidence collected at the scene.

"Ersland shows no concern for his safety as he walks by Parker, and turns his back to Parker as he walks behind the pharmacy counter," Jacobson said. "Ersland is then seen to put the pistol he is carrying on the counter, and retrieve a second pistol from a drawer."

Ersland used this pistol to shoot Parker on the ground, the detective said.

If nothing else this story is a great example of why you KEEP YOUR MOUTH SHUT if you are ever in a lawful shooting.

Ask for medical attention and a lawyer, in that order, then shut up.
 
I dunno.. I saw the security video... looked like he just decided to execute the punk to me.

EDIT: What he did might be legal... but it sure as hell didn't look moral to me. He took his time, leaned over and shot the guy point blank. While I wasn't there, his behavior didn't look like he believed he was in danger.
 
I can only see the charge holding up if the perpetrator visibly and verbally surrendered or was incapable of retaliating. Where is the video?
 
Maelstrom, not to start a philosophical debate but uh.... just because someone is a thief doesn't make it moral for you to steal from them.
 
There is a difference between Morality and Legality. We can all point to somethings that are immoral but legal or moral but illegal. I prefer to use Morality in the sense of the Christian tradition / Biblical tradition of right and wrong and then ethics as it relates to the modern world. Morality does not lend itself to shades of gray, whereas Ethics does.

In any event, when you buy chips in a game and lose, then I do not see what the problem is. The would be robber broke into a store with the intent to rob and possibly murder, he was thwarted, end of story. I do not see why I am held to an ethical level that had the roles been reversed the Robber would not be held to. I do not think that we have the responsibility of moderation when meeting force from criminals.
 
I have carefully thought about this and after what I read from today's stuff I feel that the robbery was bad, the shooting justified during the robbery.

But when bad guy is down on the floor with more shooting, that is not justified. So I call it murder.

I guess the wheels of Justice will grind out all the things eventually and this whole sad story will be closed, until the next robbery.

I have to go with the charge of murder on this one. I cannot tell you what made the guy continue to shoot. He can tell that to the Courts.

But either way, bad guy is no longer with us and we have a mess on hands. Something to remember yes?
 
1st degree Murder?

I could believe charging the guy with something, perhaps; but they are charging him with 1st degree murder.

I have been trying to locate the video, can't find it. My computer is running hinky anyway, so I will have to check in on it later, but from what I have heard, I dunno if I agree with charging him. I am tired of citizens being victimized by criminals and if the criminals prove unsuccessful, then the "law / government / state" victimizing them next.
 
On the one hand it looks bad on video, on the other the dead guy is not shown in the video so you can't see his actions that might have precipitated the 2nd set of shooting. All in all I'm glad I won't be on that jury. I'd hate to have to make this call.
 
Well, the kid still had a gun on him... maybe the guy saw him trying to get up and take aim. IMO, if you are going to commit armed robbery, you are fair game. I hope the jury lets him off.

I couldn't agree with you more. Its bad enough that decent people have to fear criminals, then they also have to fear the law as well... its just wrong. The wussification of America continues, and the bleeding hearts reign. 1st degree murder??? what a joke.
 
Let see if I got this right:
2 armed robbers enter a pharmacy to rob it, both were armed.
Pharmacist pulls gun shoots first robber in the head, robber goes down.
Pharmacist chases second one out the door, then comes back in.
First robber is laying face down, pharmacist empties gun in the first robber then reaches around and gets second gun.

Is this how it happened? That's what I read on the AP this morning.
