One Pistol Every Five Days?

Questions about buying more than one pistol in a single transaction:

I understand that the FFL must inform the BATFE when a person buys more than one pistol in a five day period. When must this notification take place? Is it at the moment of the purchase? The end of the month? The fiscal year? When?

Also, if you're the sort of person who regularly gets delayed (but never denied) will this effect the disposition of your background check for said purchase or possibly even future NICS searches?
 
I believe the dealer needs to fill out the form regarding the purchase of multiple pistols the day of the transaction and mail it in within 5 days, or maybe even within 24 hours. In any event, it's done "right away," more or less, and not at the end of the year or anything like that. Any FFL's care to fill in the details?
 
Whew!!

First it was a gun-a-month, which I can handle well enough, but a gun-every-five-days might strain my budget.;)

Oh well, might as well start stocking up on C&R milsurps.
 
I've had to do that form twice. Once I bought two handguns in one day. Once I bought three. The dealer filled it all out and mailed it in. Nobody ever bugged me about it.

While it sounds "unusual" to buy more than one handgun a day, it's actually easy to do. My dealer is an hour away. And he has a full time job elsewhere. Between his schedule and mine, it can take us a month or two to connect. So I buy a gun on gunbroker and it gets shipped to him. A month or even two later, I buy another on gunsamerica. It goes to him as well. He still has the first one. Now I'm really hot to see him so we finally get together. But legally I'm just NOW buying those two guns. Even though one of them came in a month, month and a half ago.

So that's how I ended up with that darn form twice already!

ATF reg 478.126a states when selling 2 or more handguns within 5 days, the licensee shall prepare Form 3310.4 and forward to the ATF office and one copy to the state police or local law. Local laws may limit the actual number of handguns sold in a given period of time, the ATF does not. Don't know about that.
 
Had this discussion with my dealer a little while back. The only times it is a issue is if you buy multiples of the same type of weapon.

Your dealer was wrong if he really told you that. If you buy a S&W revolver and a Glock on the same day, you have to fill out the multiple handgun paperwork.

I have the feeling that the BATFE may be interested if you buy multiple guns of the same type in one session. That they want the paperwork regardless is the usual sledgehammer to kill a fly approach....

At today's prices, it does seem a little odd (other than the "collection" issue one poster mentioned 'cause he's shipping to a local FFL), but I did watch a guy pick up two 1911's one afternoon at my local dealer's. He then left for a bit and came back and bought a third. Older gentleman - I figure they were "investments".

It applies to handguns, gentlemen. At least according to my dealer, there are no reporting requirements for purchases of multiple long guns, only handguns.
 
Moral of the story:

Buy one from dealer "A," one from dealer "B," one from dealer "C," one from dealer "D"....:D

You would think if the BATFE(ces) were going to worry about multiple purchases, it would be onguns like AR15's, AK47's, M1A's, etc. rather than handguns.

On top of the form the dealer sends to the ATF concerning multiple firearm purchases during a five day period it says "handgun". Not rifle or shotgun or even long gun.

Don't forget that one of BATFE's "missions" is to help demonize handguns. Additional harassment in this multiple-gun thing is important to that mission.... :fire:

I can't complain about trying to avoid multiple "straw purchase" situations where guns are purchased in less restrictive states and moved to more restrictive areas, although I wonder what the counts really are. :confused:

I'd go with "one gun from Dealer 'A', one from Dealer 'B'" but we only have a couple decent handgun dealers in the area. BATFE's other mission was to harass dealers out of the business.... Part of the reason that good handguns aren't cheap. :cuss:

Ever heard of "layaway"?

If you want consecutive serial numbers or something, most dealers would be willing to wait a week, especially with a substantial down payment.

Yes, I think this stuff is pretty stupid, but I live in a one-handgun-a-month state, so remember it could be worse.

Of course, as some have said, one a month has already gotten pretty expensive.:evil:
