Pistol as a gift requirements?

I want to give my son a pistol as a gift. I live in Texas and he is in the U.S. Air Force stationed in North Dakota. His residence other than the Air Force is the same address as mine and he possesses a Texas Drivers License. If he comes home is it legal for me to give him the pistol without going through FFL?

Unless he also resides at your house for some part of the year (just visiting/vacation does not count), he is legally a resident of N.D. and the pistol must be transferred to him by an FFL there.

Correct. A driver's license does not establish residency in a state for firearms transactions. Military orders to a state and/or presence in a state WITH THE INTENTION OF MAKING A HOME THERE establishes residency.

I have held a Wyoming Driver's license for 30 years. I have not been a resident of Wyoming (for firearms transactions) for the last 23 years.
