I'm thinking of sending this to my senators:

Title

This act shall be known as “The Hearing Protection Act Of 2005”.

Definition

A) The term “silencer” has the same meaning as in section 921(a)(24) Title 18 US Code.

Regulation Of Sound Reducing Devices

Section 5845(a) of Title 26 US Code is amended by:

A) Striking from ‘(7)’ through ‘and’
B) Adding the word ‘and” after ‘machinegun;’
C) Striking ‘(8)’ and replacing it with ‘(7)’

Removal of Sound Reducing Devices from National Firearms Registration And Transfer Record

Within 90 days of enactment of this act the Secretary shall direct the Bureau of Alcohol, Tobacco, Firearms and Explosives to expunge all records relating to silencers from the ‘National Firearms Registration and Transfer Record’ found in Section 5841 Title 26 US Code.

No Immunity From Prosecution

Nothing in this act shall prohibit the prosecution of a person charged with possessing an unregistered silencer before the date of enactment of this act.



Certain Record Keeping Prohibited

Section 922 Title 18 US Code is amended to add the following subsection:

A) It shall be unlawful for any Federal agency to keep any records on the intrastate sale and transfer of silencers except those silencers owned or possessed by that agency. All such records must be destroyed within 30 days of receipt.


Date Of Enactment

The date of enactment of the provisions of this act shall be in effect immediately after the signing of this bill into law by the President.
 
You left out the "findings" sections and you need a more patriotic sounding name, like, "The Preserve American Hearing Act Of 2005â€.
 
It sounds awesome, but how do you intend to get it passed?

Also, I wouldnt worry about the 86 ban until after raich and stewart have been decided sometime this april-may.
 
As soon as I make sure my bill does what I intend it to do (take silencers off the NFA) I plan on faxing it to certain politicians.

You can fax it to your congresscritters too.

Good job! Good luck getting a sponsor and co-sponsors; the more people that sign on to the bill, the better chance we have of seeing it passed.

I think it's a smart, logical step.
 
I want to see the reasons give against this bill.

It will be interesting if anyone even bothers to consider it.
 
So, to save me the trouble of looking up the US Code and comparing your bill, does your amendment turn silencers into ordinary pieces of pipe (legally speaking) or does it make them equivalent to a receiver (requiring a yellow form and a NICS check, etc.)?
