Preban lowers in NY

I live in NY, and a local shop is trying to claim that the preban (and by serial, they're right) AR-15 lowers they've got for sale can legally have a preban/evil-features upper attached by the purchaser with no repercussions.

As I understand it, given that NY has a state-wide exact copy of the 1994 AWB, that is false and constitutes manufacturing a banned firearm.

Am I correct?
 
It is false, but the idea is nobody knows whether or not they were ever assembled or not. Since "pre-ban" is a term limited to NYS and MA, it's even more moot.

A common misunderstanding. The NY AWB is not the same as the '94 federal AWB. They are similar, but self-important NY legislators re-wrote the verbiage into their own words, which makes some subtle/obfuscated/incomprehensible/scary/dangerous differences.

You really need to read that law for yourself and determine what's legal.
