Premature question: AL CCW approval?

It's looking more and more likely that my wife and I will be moving to the Huntsville, AL area in about 18 months. I just got to thinking about my CCW permit.

I didn't see anything in AL state law that dictates how long a person must be a resident before getting a permit. Is this at the discretion of the sheriff? If so, does anyone know if the sheriff in that county issues?

Lastly, if there's a wait for residency, will my FL non-resident permit suffice?

My friend just moved to Huntsville a few months ago. He said it's ridiculously easy to get your permit. Not sure how long you have to be a resident though.

I did carry my P11 down there with my non-res FL permit. Glad I got it.
 
I just went in and picked up my application this week. According to the booklet they gave me, the Sheriff wants a 6 month period to establish residency.

It would be questionable to whether your non-resident permit would be valid during any waiting period because out of state permits are only valid if you are not a resident of Alabama. The legality of a waiting period is questionable in my opinion but someone would have to challenge it to set a precedent.

Worse case open carry is legal and you could use the argument that you don't want to have to open carry but if the sheriff insist on a waiting period you will be forced to open carry. By the way open carry is not very common place in Huntsville.

The gun laws in Alabama are very good over all and I think you will like it here.
 
It certainly doesn't hurt to go in and try it though. It isn't going to hurt you in the long run, if there is a six month wait, you just go back in six months. If they don't catch that you just moved there, as long as you truthfully answer the application questions, then you get your permit!
 
I don't think there's a statute for residency. Since we'er a May Issue state, it depends on the Sheriff's attitude. Just fyi, I got mine within a few weeks of moving into Lee County. Jefferson County (Birminhgam), the most "urban" county in AL, routinely has tables at the big gun shows with applications, instructions, and deputies there to answer questions. How I love living in AL!!!
 
While Alabama is a may issue state the AG has issued an opinion that states "the sheriff may not arbitrarily refuse to issue a permit without a sound reason".

Edit to say that this opinion is based on case law.

There is no state law requiring a waiting period.
