What are the laws in Oregon regarding transfer of a firearm from one private party to another? Can anyone help with this? Thanks!

Welcome :)

You can sell a private arm to another private citizen without going through any hoops or anything else.

Unless you have cause to believe or know the person is a restricted person, then you can't.

Thanks!

Thanks for your reply (and the welcome)! What if that person turns out to be restricted- is there a potential backlash?

elcabron, if you have any doubts about the person, it is better to not sell the gun. If you wish (or are unsure) you can take it to an FFL and have the paperwork done with the person and the FFL can call in the check. The FFL will probably charge a "book fee" as well as the NICS fee. The "Book Fee" is the trouble he (or she) has to go through to log in the firearm and then log it back out. This fee is usually the same as the fee they would charge for a transfer, $20+ dollars is the norm around Eugene.

If you have no doubts or suspensions with the person and you sell the firearm in good faith then even if the person turns out to be a restricted the feds will probably just beat you alittle bit :D.

What I do is get the persons info. for my records. Usually a DL number (try to get a copy of the whole license) and then write a "bill of sale" under it. Then copy it again and you keep the original and they keep the other. I put alittle "blub" in it that states, "The buyer, (put name here), has declared to me that they are not a prohibited buyer of firearms. And both of you sign it. Like a bill of sale for a car. Any CYA is good, just don't act as if you are infringing on their Rights (like really be nasty about it).

Remember, it's your property. If you don't "feel right" then go to a FFL or get something in writing like a Bill of Sale or just don't sell it to that person.

If the original aspect of your question is does oregon make you go through an FFL, or do a bill of sale, or it has to be registered then the answer is no, no restrictions on private sales (unless you sale it at a gun show).
