Proposed NY Bill A08159 amends and repeals portions of the so-called 'Safe Act', problem is it doesn't go far enough.

The bill is a nightmare to try and read with items being repealed surrounded in [] and new items in caps. Essentially it removes the detachable mag and one item definition of an 'assault weapon' and changes it to a detachable mag and two items from the list BUT then it adds in specific makes and models of gun considered AWs very similar to the CA and CT AW definitions.

The bill also adds back in a grandfather clause for high cap mags made prior to Sept 13, 1994.

I guess from a New Yorkers point of view it's better then what they have now but it's still draconian.

I would probably rather have the list of features versus a list of specifically banned guns. You can atleast deal with the features. If you want an AK, you can get a neutered one like a Saiga. But if Saigas and AKs are specifically named. Then there's nothing you can really do.

There are two options

First one is to kill the legislation (good luck with that, its NYS) and pay the courts declare the entire thing unconstitutional. Second one is to work to to improve the law, with the understanding the original law was unconstitutional.

At this point its game theory.
 
Doesn't Bloomberg own the state? He will just eliminate any opposition.

That has been law since 1994 or whenever they implemented their federal copy.

The problem (for them) when specifying a name EXACTLY means that a single letter change makes it not banned.

The COLT AR-15 is banned while the Spikes SAR-15 is not, provided it passes the feature test. The FAL is banned, while the L1A1 is not. Get it?

Means all AK's made by Norinco, Mitchell and Polytech are banned, while Arsenal/CAI/etc ones are not.

I just read where Kahr is packing up to leave New York for Pennsylvania. The gun industry
is starting to take their business to states where it is appreciated along with the jobs
that go with it.

That is pretty much it. This would roll back the AW definition and mag capacity limits to what they were from 2000-1/15/2013.

The new laws are worse than the old laws, but the old laws were draconian as well.
 
There go my chances of buying a Saiga I guess.
Oh well, parts kits and 80% blanks for me then. Really wanted a proper Russian AK though.

And yeah no getting around it with a Vepr. The law covers ALL AKs. It's not like some states I heard about (not sure if true) where they just wrote the law as banning Colt AR-15s. So you could still have an AR as long as it isn't a Colt.

They didn't enforce the previous law, unless you did something stupid and got caught, like telling an undercover police officer that you had post-1994 magazines.
 
Post Federal AWB and pre NY Safe Act, ARs were legal in NYS with certain feature limits. No bayonet lugs, flash suppressors, or collapsible stocks being the main thing (unless the gun was pre-ban). Also the 10 round magazine limit was still in place for all mags manufactured post Federal AWB.

Baloney.

The law just means different than what you think it means, seeing as all the dealers selling and transferring NY-AWB compliant AR-15's.
