NY Ban/Confiscation of AW's

I do not want to see any body try to live on under 3 grand a month and try to stave off the few bills still owing with so little to offer.
Darn shame that the buisness you had was pulled down by .gov goons. But I have to ask, if you were pulling in 6x what you are now, did you not plan ahead and stash away for the "Golden Years"? As for living on less than $3k/month, I know location as A LOT to do with it, but I've had no problems doing that, while stashing away at least 20% post tax, maxing the 401(k) , aggressively paying off the note on the house and having the toys. Oh, and I don't live in a cheap area either. Its about sound financial practices.

Social Security is a weath transfering Ponzi scheme, nothing but. When a private citizen tries to set up the same, they get charged with fraud. I don't expect it to be there when I'm eligible, so I plan accordingly. I MAY pull it when I'm eligible if its still there, but only for my own wealth re-transfer back to some stuggling young families who are being robbed at gun point by the SS system. [/Rant]
If all the guns were gone, bows and arrows, machetes, pocket knives and sticks would be on their "must ban" list.
Yeppers, just look at England and Australia and their attempts to ban edged weapons. I do hope that the folks in New York state can kill this off, and not just for their own sake. The Colorado legislature is Dem controlled now, and while I don't think lots of them are as anti as the loons on the coasts, there is a leftwing undercurrent in our population centers.

Riley, I will gladly pay for roads and infrastructure. In a free country, I would not be forced to pay for geezer's medicine and walkers. End socialism security now and give the geezers back what they paid in. Make each person responsible for themselves. Let voluntary charity fill in any gaps.

No government has the right to compel you to pay for the retirement of others. No government even has the right to compel you to save for your own retirement. This is basic and you should know this.

The U.S. government steals money from the producers in this country to buy votes to stay in power. Pure theft.

In 2000, New York`s penal law was amended to define military-style weapons and weapons with excessively large ammunition capacities as "assault weapons."
Good god!! I had no idea a Beretta M9 was an assault weapon, or the USPT, mk23, garand, lee-enfield,mosin-nagant, m1carbine,glock, hold on... Isn't every gun, with the exception of a few CCW guns Militay style?

PS- Is this NYC or NY State?

So, if I understand this rightly,... my Colt Commander is an "assault weapon" as well, or is it not becuase it holds less than ten cartridges?

Guess the 3" Model 66 is exempt,... for now.

So regretable that I had to take this promotion in NY. What a shame to have to had sold off such a gorgeous collection.

I need to start looking for either another promotion or a lateral move to a more firearms-friendly environment.

I Love NY

We get a plethora of gun bills every year. Last year they (Pataki) wanted to revoke our pistol permits and make us reregister at a much greater cost and hassle. This year its a redefinition of AW's :banghead: . There are some good bills out there also. Like this one:

Assemblyman Joe Errigo introduced A-5093 to scrap the COBIS ballistic database, now up to about 90,000 cases at a cost of $16 million with no crimes solved... Pataki still thinks he can make COBIS work by linking it to some federal database.

You can get an itemized list of pending NYS Gun related legislation here: NYSRPA Legislative Report #3

Sindawe: Any place north of Westchester County is pretty Conservative. Take a look at the Red vs. Blue Election map. The blue parts of NY have a lot of people who vote for liberal politicians because they get "free stuff". As is the case everywhere the blue spots are also the places that have the highest crime and poverty - go figure.

It seems certain States get those kinds of Bills every legislative session. I would work to block it, but I would not stay up all night worrying about it, unless it is pretty much a done deal from the get-go.

Regarding Social Security, not only have the workers paid into it, but so have the employers. They are getting ripped off too, and some of them are mighty powerfull. Maybe the Government should reimburse the employers too besides the Social Security recepients. Yeh, right.

By the way, it appears that 75% of the people applying for Social Security are doing it at the earliest age that they qualifiy, which is 62. So, I think that means they get a 20% permantedly reduced benefit. Everybody I know who is getting near 62 will take early payout.

For the baby boomers, I think most of them cannot get 100% benefit until at least age 66.

It's going to be tough for people who are young now. Whey they get to 60+, they won't have any social security or any guns, if the current trend continues. Maybe they'll do something about it now. I'm not hopeful.

AK parts kits and receiver flats are REALLLLY cheap and don't have any serial numbers, don't have to go through an FFL...

I'm just sayin'....

In other words, say goodbye to your "post ban" models!

And the hits just keep on coming...

Hello everybody.â„¢

^^ ...sad... :(

Let the future tyrannies embrace gun control, as the people recognize that crime is inversely porportional to the number of guns in trained, lawful hands really makes sense. And then, and only then, can we say "See, the outlaws have the guns, and they are freely able to excersise their power over us, the government is free to impose any law, break any law, unto its own whim, till we are broken."

Sometime, we need to declare a Second Magna Carta. This time, instead of soldiers encased in armor that wouldn't even stop a pistol round nowadays, it will be angry citizens with pistols strapped to their belts weilding assualt rifles that the Anti-Gun people call "evil."

However, I also doubt that a Second Magna Carta will happen. Why? Because our current generations are stupified, brainwashed, and worst of all, are a complete mockery and disapprecation of the past, where a gun was a man's constant companion. Did they know something we don't? Of course.

No one will defend you, so you have to defend yourself. If you do have bodyguards, plan on Darwin meeting you in his office: Murphy's Laws will probably come into effect. How can you even trust some who really isn't bound to you morally, only physically by means of a paycheck?

Ahh...the old days. :barf: :barf:

The NRA website http://www.nraila.org/CurrentLegislation/State.aspx?ST=NY for NY legislations only has info on the Senate bill but nothing on the House bill.

Hopefully the NRA will work to help defeat these idiotic pieces of legislation.

After reading and re-reading this Senate bill, it appears that its purpose is to simply define an "Assault Weapon" by both description and also by certain specific brands and models. It does not appear to "ban" them or restrict ownership. The house bill is what does the banning and confiscation of "assualt weapons".

It was largely because I read the writing on the wall that I abandoned NY State, the state of my birth and upbringing, last year. I am now a resident of a state which acknowledges my right to keep and bear arms. The fight is pretty much hopeless in NY State. Move to a free state, is my advice to you. Leave NY for the socialists, and let it collapse of its own weight like the Soviet Union.

And people ask me why I love the state of Alabama so damned much...

I shall never leave this beloved state of mine, nor will I abandon it's peoples.

Evil5liter; When I was in the military for 10 years I determined that if we got into a shooting war I wanted a good ol boy from Alabama to be in my squad. I found that for the most part they were good rifle shots, patriotic w/o being maudlin, and were true friends. Sometimes they had to endure jokes and wise-@$$ remarks from the "city slicker" contingent but they seemed to get over that. :)

Phil,
You couldn't be anymore correct.

I often wonder why the south gets the raw end of the stick, because if it ever comes to a SHTF situation, who do you think will be the best equipped and best trained citizens?

Or to put it another way:

Who owns the most camo?
Who owns the most guns?
Who knows how to live off the land?
Who knows all about stalking prey?
Who knows the anatomy of their prey?

Not to mention millions of wooded acres in which to hide, and a thorough knowledge of the area.

If you were an invading country, you would positively have to be retarded to try and invade through the Gulf of Mexico.

OK... here is are some tools that YOU can use to fight & defeat the new NY AWBs' that have been proposed. What follows is a bare minimum contact list, and 3 sample letters that YOU can mix & match, cut & paste, and generally plagiarize.

Time to roll up our sleeves & do the hard work that freedom often demands...

Dear Assemblyman XXXXX,

As a registered voter and life long resident of New York, I am writing you in order to express my strong opposition to any amendment or strengthening of our state’s so-called “Assault Weapons†ban. Recently, several of you colleagues in Albany have introduced legislation that would impose unacceptable limitations on law abiding gun owners while doing nothing to control or prevent crime. These bills (A.03371 & S.2445) are clear infringements of every New Yorker’s right to bear arms, and as such they should not be tolerated.

The roll that these unfairly maligned and demonized firearms play in crime is statistically negligible. The only thing accomplished by such restrictive legislation is the piecemeal infringement of our Second Amendment rights. If left unchecked, gun control will worsen to the point that the right to bear arms will be a hollow concept, and the individual citizen’s right to personal protection will be negated. Rather than further limiting the types of weapons that responsible, law-abiding citizens have the right to possess; I encourage you to focus your energies on toughening the consequences for those who illegally use firearms in the commission of violent crimes.

By standing in opposition to such draconian legislation as A.03371 & S.2445, you and your party will benefit by gaining the favor of countless New York gun owners who actively support their freedoms. I’m deeply passionate about this issue, and I know many others who take gun control into serious consideration when entering the voting booth. You Sir, stand only to benefit by supporting our right to bear arms.

Thus, I once again implore you to stand in opposition to any and all incarnations of a strengthened or amended “Assault Weapons†ban.

Thank you for your time, and I would appreciate a reply from you to learn your position on this very important issue.

Regards,

XXXXX

Dear Senator XXXXX,

As an avid hunter and registered voter I want to encourage you to work against the passage of any & all legislation that threatens to amend or strengthening of our state’s so-called “Assault Weapons†ban. These unfairly categorized sporting guns neither cause, nor significantly contribute to violent crime in New York State, and recently introduced legislation aimed at further limiting their ownership (A.03371 & S.2445) serves only to erode & weaken every New Yorker’s God given and Constitutionally enumerated right to bear arms. Any elected official that supports either of these gun control bills will lose my support, and the support of my family and friends across the board.

Please understand that the frustration of New York’s gun owners stems from years of incremental erosion of our personal freedoms. The “Assault Weapons†ban is clearly an infringement of these rights, and as such, it needs to be cast upon the ash heap of history. Any political compromises, back room negotiations, or last minute concessions that result in the strengthening of the ban will be viewed as a rejection of our nation’s founding principals, and as a betrayal of the countless New York sportsmen who work, raise families, pay taxes, and most importantly…vote.

If you truly want to combat violent crime in our state, please support measures that are effective and that do not infringe upon the rights of honest, responsible, law-abiding people. I encourage you to focus your energies on strengthening the penalties for those who illegally use firearms in the commission of violent crimes. Go after the criminals who flout the law, not the citizens who obey it.

Hence, I once again urge you to oppose all efforts to amend or strengthen our state’s “Assault Weapons†ban, and I remind you that any attempt to pass A.03371 & S.2445 will be remembered none too fondly come next Election Day.

Thank you for your time and I look forward to your reply.

XXXXX

Dear Assemblyperson XXXXX,

I am writing this letter to direct your attention to the current move afoot in the State Senate & Assembly to amend and strengthen New York’s so-called "Assault Weapons" ban. I want to urge you in the strongest terms possible to oppose & defeat any and all pieces of legislation that would further infringe upon the gun rights of the law abiding, tax paying, politically active sportsmen of this state.

The usual anti-gun politicians in Albany are calling for a needless amendment of the current ban (in the form of S.2445 & A.03371) that would criminalize the possession of self-loading shotguns (a favorite of hunters), most detachable-magazine self-loading rifles (used by marksmanship competitors), and so called “pre-ban Assault Weapons†which are currently & legally owned without incident by countless New York gun enthusiasts, hunters, and collectors. Please understand that the unreasonable efforts of these freedom-robbing politicians should not be supported or tolerated in the least.

I feel compelled to also point out that in every major federal, state, & privately commissioned crime study that has ever been conducted, "Assault Weapons" play a statistically insignificant role in violent crime. The only thing accomplished by such restrictive legislation is the continued erosion of our Second Amendment rights. Rather than further limiting the types of weapons that honest, responsible, law-abiding citizens have the right to possess; I encourage you to focus your sights on toughening the legal consequences for those who use firearms in the commission of violent crimes.

Thus, I urge your vigorous opposition to any legislative effort to strengthen or amend New York State’s "Assault Weapons" ban, as well as to any other measures that effectively deny citizens the right to choose which ever means they deem to be appropriate in protecting themselves and their loved ones.

Thank you for your time, and I would appreciate a reply from you to learn your position on this issue.

Best regards,

XXXXX

Well there you have it… a damn good resource for becoming politically active & involved in the fight aganist New York's freedom hating politicians. While comprehensive, this post is by no means complete. Feel free to add your own unique sample letters for others to draw ideas & inspiration from.

The choice is clear fellow NY'ers... Sacrifice time, money, and effort NOW, or we just might be sacrificing blood & tears in the future!

There's More Folks

This just in from the NYSRPA. Apprently there's a movement afoot that would attempt to restrict the sale of 7.62 ammo (the caliber used in the Kingston shootings last week).

Don't let this thread die on the vine guys! It's far too important.

Let's see some other examples of letters that we have sent to our Reps.

Give your fellow board members some different arguments and approaches to draw from for their letters!

If not us, who? If not now, when?

FISCAL IMPLICATION:

None.

Yeah, right. It won't cost anything at all, nope, not one red cent, to collect tens or hundreds of thousands of firearms. It certainly won't cost anything to investigate why, 6 months after the effective date of this law, only 174 "assault weapons" were turned in. Nor will it cost anything to have police officers match known owners of "assault weapons" with the meager turn-in list. Of course, it'll cost nothing to send a truckload of ninja-clad officers to hundreds or thousands or tens of thousands of homes. And, of course, the loss in tax revenue from burned-out houses, dead (formerly productive) citizens and some officers is cost free.

I would be more than satisfied to live for the rest of my life on 1/10 of what this "no fiscal implication" law will cost to (quite unsuccessfully) implement.

This is an "all hands on deck" moment folks.... are you a citizen or a spectator???

Carpe Diem!

does it include ALL semi-auto rifles, shotguns, and handguns??
Technically, no. Not all semi's will be banned.

HOWEVER, most semiautomatics accepting unrestricted-size magazines are based on one of the named banned models. Thanks to poor wording of the original NY AW ban, the receivers themselves are banned regardless of what's attached - NY law enforcement simply has not caught up to that yet.

Ergo, upon passage of this bill nearly every semi-auto will be banned - it's just a matter of how loosely they want to interpret the law and let the courts decide the actual line (after much theft, destruction, imprisonment and killing).

UPDATE: New York Assault Weapons Bill To Be Heard On March 1

Friday, February 25, 2005: A bill that would drastically expand the state's current assault weapons ban by redefining what constitutes an "assault weapon" will be heard in the Assembly Codes Committee on March 1. In addition to expanding the ban, A 2466 would require those who currently own any firearm deemed an "assault weapon" to register it, render it permanently inoperable or turn it in to the police.

Those who choose to register their firearms would be subject to an additional NICS check and would be required to have the firearm tested for entry in to the state's ballistic imaging program. Last week, we reported that Senator Eric Schniederman (D-31) introduced S 2445, which also seeks to expand the assault weapons ban by outlawing many more guns by name and adding specific features to the definition of "assault weapon." Please contact your state Assembly member and Senator today and ask him or her to oppose A 2466 and S 2445!

MY letter

Hello all, I would like to post my long handwritten letter to see just how powerful you people think it is...

This letter is in regards to the A03371 firearms bill. In addition to a massive infringment on my Second Amendment rights, this bill extends government control to unheard levels. Before I discuss how this affects me, let me enlighten you on history.
Just before committing massive atrocities and the most heinous crimes, both Hitler and Stalin used their governments to confiscate civilian-owned weapons. If you would like to see this again, then pass A03371.
In the 20th century, 170 million people were murdered by their governments worldwide. This is significantly more than all the people killed in all 20th century wars combined. All of these "governments" confiscated the people's firearms. If you would like to see history repeat itself, pass A03371.
I am a future United States Marine, fighting for the very freedom your government is stealing. I understand that, as a Government Issue, I am ordered to follow laws. However, once the government (the NY state Government) becomes illegitimate, illegal, unfair, and baseless, then my service is in defense of civil liberties and our much respected United States Constitution. I quote a phrase from the Oath of Enlistment; "I will support and defend the Constitution of the United States, against all enemies, foreign and domestic". Do not override my Constitutional rights as a freedom-loving and freedom-defending American.
IF it is practiclity that you seek, then consider my next point. In order to keep up my marksmanship abilities while off duty, I will need to practice. This cannot be accomplished without a weapon similar to the currect service rifle.
However, I digress. That is beyond my point. You may as well just spit on the Constitution, assuming this law is passed with your support. I beg you to consider the ramifications of this law. I will personally leave NY state and many others will follow. Your government will receive letters from gun-rights supporters from around the country.
NY state has more important social, economic, and political concerns aside from expanding gun control. Your government needs a desperate lesson in prioritization. Please do not allow this law to pass. It will only infuriate law-abiding citizens exercizing their Second Amendment rights to bear arms.
Signed,
A disgusted resident of NY,
Nicholas Joseph Russo

Njr5681, that's a good start & welcome to the fight!

My only suggestion would be to edit it a bit for the sake of brevity & focus. In any letter to your elected reps. you want to get you main point (this bill is bad, don't support it, there will be political hell to pay if you do) across in the first few sentences.

Sure... make your supporting argument in the body of the letter, but always assume that they will not read beyond the first paragraph.

Hope this helps, and thanks for getting involved my friend!

I'm not sure who you're sending this to but if you're in the same position as I your Assembly person will round file it and vote however Sheldon Silver tells them to. The Downstate liberal crew controls the Assembly and Governorship, especially with respect to firearms and there's nothing us Upstaters can do about it - yet.

Every year we NY'ers get a plethora of gun control bills that usually don't succeed. Every year I call my Assemblyperson and express my displeasure at the anti-gun bills and support for the pro-gun bills (there are several). Every year I may as well complain to my garage wall.

I don't need to contact my State Senator. The Senate is our only option in dealing with this stupidity and they typically block any new attempts at gun control. Thank God for folks who organized our State Government.

Keep sending letters, emails and calling them. If you ever get a chance tell them in person. Join the NRA and NYSRPA . Most of all talk to your friends, family and anyone who cares to listen. Tell them about some of the dumb gun control things we have (like COBIS) in NY. Tell them about the positive influence of guns on our society. Most of all know your facts. If we can chip away at the liberal platform, God willing, the coming revolution will be a peaceful one.
