Quite some time has passed since I purchased a firearm from a dealer.

However I recall the form included a series of (YES/NO) questions.

One of these questions included,

"Are you a fugitive from justice?"

What if someone was a fugitive and was intellectually challenged -- they marked "YES" -- how would you proceed?

I can also see some intellectually challenged person marking "YES" as a joke.

I'm just curious if this has ever came up before.

If the customer answered any of those questions "wrong", the clerk cannot sell him a gun. Period. The NICS check would detect a lie in which a fugitive said that he was not, but if he says he is, the proposed sale cannot go any further. The clerk would call the police.

Needless to say, a lot of discretion is involved, as the clerk should not put himself or his other customers in danger.

I know that BATF changes the 4473 for what appear to be random and arbitrary reasons. That stupid list of questions... some of them you have to say yes to, some you have to say no to, and I think their idea of an important change to the form is switching up the order of the same questions.

Although one good change was switching it from that irritating fold-out design to a booklet design.

I don't know about that "joke". lol When I fill out a form I write everything out, no abbreviations and in all capitol print.

I hope I'm wrong, but I have never heard of the police being called because someone answered wrong or failed the NICS, even though it is a felony for a felon to attempt to possess a firearm. Does this happen in your area?

more then once we had a stoner say "yes" to the drug Q... they would get really pissed when we would tell them "sorry, we can't sell you a gun"

So if the purchaser truly is a fugitive from justice law enforcement does not get called?

Discretion of the dealer; I never saw someone mark that question yes in my years in the business though.

Saw about everything else, but that wasn't one of them.
