Question on NICS checks

Here is my situation, I have passed multiple NICS checks in the past, some were delayed others were not, but all eventually passed. Most recently I was denied on a .17hmr rifle (I assume it was because I had a pending DUI charge that was later changed to a reckless driving charge)

Anyway I never bothered to do an appeal on it; mainly because the store sold that particular gun to someone else but also because I was too lazy to go through the whole; write in, wait for their reason, then write back to contest it bs.
I am now thinking of trading in two guns I currently own for something else. My question is, will I be denied again because I never appealed that last one? If I take my two guns in and fail can I keep my guns if they won't let me have the new one?

As I mentioned I had a pending charge at the time but that has been taken care of for some time now. Any advice would be appreciated and thank-you in advance.
 
If your assumption as to the reason for denial is correct, the only applicable reason I can see for denial is:

"A person who is under indictment or information for a crime punishable by imprisonment for a term exceeding one year."

I don't know what State you were charged with DUI in but I think most first time DUIs would face 365 days in jail with all but a few suspended. That would not meet the test above. Of course, your State may be different.

If you trade the guns in and the FFL enters them into his book, I seriously doubt he will be returning them to you if you get denied.

If you really think the reason for the deny is what you said, and it's been cleared up, I would go buy a used NAA .22 or something equally cheap to see how the chips fall. I would not tie up a bunch of guns in a trade deal on the first one.
 
Thanks for the advice, especially not getting trade in guns mixed up in the mess. I noticed in another thread someone had posted a webpage where you can digitally submit an appeal. Thankfully I still have my brochure and NTN# so I just went that route.

Still annoying I have to wait but hopefully the E-appeal will speed it up, guess this gives me time to burn off the ammo I still have laying around for these guns.

My record should be clean unless its a case of ID theft; was just wondering if a previous denial would be grounds for a future denial even considering everything else is clear.

My thought is criminal records are much like trying to get a refund on a purchase; it takes them 5 seconds to take my money in the first place, yet somehow it takes 6-8 weeks to give me a refund, go figure.
