The West Virginia eighth-grader who was suspended and arrested in late April after he refused to remove a t-shirt supporting the National Rifle Association appeared in court this week and was formally charged with obstructing an officer.

14-year-old Jared Marcum now faces a $500 fine and a maximum of one year in prison.

Obstructing an officer...

let's see Marcum was in a lunchroom so he didn't disrupt a classroom, and the officer's order to stop talking is not one he has legal authority to compel compliance of...

I think when this settles down the family should personally file a 42 USC 1983 complaint personally against the officer
 
I guess they have nothing else better to do than jack with a 14 Year Old over exercising his 1st Amendment Rights.

I hope the prosecution drops it or gets laughed out of court.

Just goes to show how stupid things have gotten. I have seen far more offensive shirts worn by kids in schools with no repercussions. For the school administration to act this stupid is not surprising given the state of the liberal brainwashing our kids and teachers are fed but this police officer's actions are inexcusable and a blatant abuse of power.
 
Let's play devil's advocate. Say the kid didn't stop talking and was causing a disruption. Isn't that something that warrants a detention, not a year in prison? He's 14. Even an adult who is charged with disturbing the peace usually gets off with less.

Even if both the father and son were known loudmouths and made headaches for the district, I can't fathom anything they did, that would warrant prison time for a 14 year old.

I got in more than my share of trouble in Jr. / Sr. high school than I care to admit, smoking, skipping, fighting, and yes even drugs (hey it was the 70s) and never ONCE were the police called.

So *** has happened to society that requires police intervention for a stupid t-shirt?
 
i'm glad that I'll be dead and gone and 10 feet under in 30 years!! This world is going to hell...quickly! :cuss:
 
If I were the parents, I'd get that kid into acting classes asap so he can put on one hell of a show of "emotional distress" and thereby set him up financially for quite a while with a big fat lawsuit against the city. I'm not much for being dishonest, but when it comes to sticking it in the eye of The Man, especially when He deserves it, my standards suddenly get much, much lower! ;)
 
I sincerely hope him and his parents crush these thugs in court, then sue and get a huge settlement.

Boy, do I wish we could still brand a big ol' K on prosecutors foreheads for frivolous suits.
