I wrote (and called, and called) Senator DeWine during the battle over S.1805 regarding both the Protection of Lawful Commerce in Arms Act and the AWB extension amendment. Here is the letter I received in reply.

Dear Mark,
Thank you for contacting me regarding the Protection of Lawful Commerce in Arms Act (S.1805), which failed to pass in the Senate on March 2, 2004, by a vote of 8 to 90. I appreciate knowing your views.

As you know, the Protection of Lawful Commerce in Arms Act would have prohibited several types of lawsuits from being brought against firearm manufacturers, distributors, dealers, and trade groups. Specifically, the Act would have -- except in very limited circumstances -- prohibited any person who is injured by unlawful gun violence from suing firearms sellers who irresponsibly or unreasonably provided guns to criminals. The Act's lawsuit prohibition also contained language that would have effectively terminated numerous pending civil lawsuits, including the lawsuit against the dealer who appears to have allowed, through negligent behavior, the Washington DC snipers to walk off unnoticed with a 3-foot assault rifle.(sic)

I do believe that we do need responsible tort reform measures in the Senate. However, I could not in good conscience support this bill. Although there are, without a doubt, many frivolous lawsuits, there are also legitimate cases where victims of negligence should be allowed to take their cases to court. This bill would have disallowed innocent victims of gun violence to hold irresponsible individuals accountable for harmful and negligent actions.

Providing the firearms industry with this immunity would have overturned over 200 years of civil law in this country and fundamentally changed our justice system. S. 1805 would have denied one group of our citizens access to the court system. I believe that we must trust the good judges we trust in every other civil suit in this country to make the decision to throw out frivolous lawsuits. We do not and should not exempt any industry in this country for their negligent actions. Passing this bill would have changed that and set a terrible precedent.

During the debate of this Act, the Senate voted on numerous amendments. Several received particular attention. I would like to explain my thoughts on some of these amendments.

First, I supported the Assault Weapons Ban. I voted to renew this ban because I feel that violent crime is a serious problem in our Nation and that this ban helps to keep out of the hands of criminals weapons designed to virtually fire -- indiscriminately -- numerous bullets in a very short period of time. Law enforcement has urged me to support this renewal. The ban makes exceptions for more than 670 hunting and recreational rifles, and at the same time the assault weapons ban does not limit protected weapons to just this list.

I also voted for the Gun Show Loophole Closing Act, an amendment to extend Brady background checks to all purchases at gun shows. I support the rights of people to hold, conduct, and attend gun shows. Under current law, however, some sellers at gun shows do not have to conduct background checks on purchasers, while others do. As a result, we wind up with the situation where Americans pay for a sophisticated and expensive background check system that can easily be avoided by criminals. That doesn't make sense. Indeed, according to federal officials, gun shows are the second leading source of illegal guns recovered from gun trafficking investigations. Also, following the attacks on September 11th, it cam to light that the organization funding these attacks, Al Qaida, produced a handbook in which it advised its followers to purchase firearms at gun shows in the United States. Therefore, it is imperative, now more than ever, that we enact legislation to protect our citizens.

Finally, I supported the Steve Young Law Enforcement Officers Safety Act, an amendment to allow qualified current and former law enforcement officers to carry concealed firearms in and jurisdiction in which they travel or live. I voted for this legislation because I believe that having more armed officers on the streets will help improve the security of our Nation and its citizens.

I support the Second Amendment right to bear arms. I also feel that gun violence is a serious problem in our Nation and that the best way to reduce the illegal use of guns is to pass and enforce tough laws that severely punish criminals who use them illegally. Throughout my tenure in the Senate, I consistently have supported measures to balance the legitimate rights of law-abiding citizens and gun owners, with measures to keep firearms from getting into the hands of criminals. While there is much debate on the Second Amendment, I believe we can successfully protect our constitutional rights while punishing and discouraging those who would abuse them.

Way too much double speak to be worth breaking down...but I think I will contact him again...to tell him I'm voting for someone else.
 
Sounds like he had no idea what was actually in the bill...or any of the bills, or else he's trying to BS his constituency, or (perish the thought) all the above.
 
In the spirit of John Glenn and Howard Metzenbaum, another raving anti-freedom Ohio Senator. :fire: Voinovich is no better. Why, oh why can't we do better? :banghead:
 
And to think that people look at me funny when I tell them that I swam across the river to escape the RINOs (although to be fair, they probably hear rhinos :rolleyes: :D ).
 
Ohio's Senators are each from the Raving Looney Wing of the Republican Party -- aka, Closet Democrats.

My senators are both Democrats. My congressman is Mike "Lets renew the AWB" Castle, a Republican. I wrote him a letter about it and the Lawful Commerce in Arms Act. Lets just say his response was basically "I don't agree with you and will do what I want." Wow thanks. Too bad he's the only Republican in higher office in my state.
 
I got the exact same letter from DeWine about a month ago.

I had called his office and asked his aide, "Why?" I asked for DeWine to re-read the Bill of Rights and his Oath of Office and answer the question, "Why would you vote this way?" or better yet, "How could you vote this way?"

I also called the Ohio Republican Party and told them that I was withdrawing my financial support of the party until DeWine is out of office. The guy I spoke with (Patrick) tried to convince me to contribute to other campaigns. He even told me I could put "No Money for DeWine" on my check and they'd put my money to use elsewhere. I declined and replied, "DeWine might as well be a Democrat the way he votes, and if he's the best you guys can give me in Washington, why should I trust you to give me a good candidate here in Ohio?"

I'm done with the Ohio Republican Party. :fire:

I'll make my contributions directly to pro-freedom candidates as I decide.

Ohio Republicats? Aaarghhhh!

I recently moved back to Ohio after 25 years in Alaska, and the GOP in Ohio is totally different from the Repubs in the west. Maybe it comes from being the dominant state party for too long, but Governor Boob Taft, the two senators, and most of the local office holders would qualify as liberal Democrats in Alaska. I also noted that Ohio has the third highest state and local tax levels among the 50 states. Not exactly what one would expect in a GOP-dominated state.
 
Voinovich is up for "re-installment" this cycle. The other Repub in the primay as I recall, got about 25% of the R-vote.

But the Dem running against Voino is State Sen Eric Fingerhut...as big a gun-grabber as Fineswine, Schumer, & ASSociates.

Not much choice for Ohio, eh ? ? ?

Fingerhut [Finger-in-your-eye-hut] did everything he could to oppose CCW reform here. Trotted out the usual MMM/Brady/VPC stuff..Blood in the streets...Parking lot shootouts...Dodge City....Just drive away/call the police.

I was wondering if anybody else would pick up that DeWine thinks that "assault weapons" virtually fire bullets as opposed to firing real bullets....just one more thing that proves that he doesn't get it!
 
I got the same letter from Dewine a couple of months ago. I will vote against him next time.
 
But if you don't vote for him, a Democrat might get in power! You have to vote Republican no matter what the Republican wants to do to you. Just say "Yes, sir" and nod your head. Don't you dare vote for someone who isn't a Republican. You'll be throwing your vote away! If you even think about voting for someone else, you're a silly, starry-eyed idealist with no grasp of reality.

I am tempted to vote for Fingerhut just to get rid of one of our Repub. senators. They are *too* comfortable in their positions and need a shake-up.

Hell, if our RINOs are voting like Democrats anyway, why not have a Democrat there? Might make the Ohio Republican Party think about the sad, sorry excuses for conservatives we have in office now...

You probably would make a pretty decent Senator. There is no way you could ever be any worse than the 2 clowns that occupy those seats now.

{I remember Sen DeWhiner saying something about he never heard anything from constituents regarding the AWB amentment, etc to the Commerce in Firearms act. A BLATANT LIE. I called both the local (Cleveland) and DC offices} . Just to give him the benefit of doubt, maybe the office aides weren't passing along our concerns. If so, those folks should be fired.

The Senate race this time around REALLY has me in a knot. What choice do we have? A far-left Demo, or a far-left Repub? Sheeeeeeshhh

I have put in a request to both of our esteemed Senators offices for my "10 minutes of face time" to discuss the Dept. of Labor's attempted wrecking of overtime pay rules, and the AWB issue. No reply from either.

But I already have an appointment with Rep. Steven LaTourette to discuss those things. All meeting requests went in the same day.
 
In this election, both R and D are gun grabbers. On gun related issues, same result either way. Unfortunately, we have the dilema of choosing R grabber or D grabber. I want to vote Voinovich out to show him that he can't take our vote for granted. However, he does usually tow the party line which will be important for federal court confirmations. If the balance in the Senate weren't so close . . . I don't know what to do. :uhoh: He took the primary easily (without my vote). He panders to the liberal majority in northern Ohio. Changing his behavior is not practical. :confused:
