S.C. Legislator Arrested After Shooting :uhoh:

CHARLESTON, S.C. -- A state lawmaker was arrested after his pistol fired as he confronted two utility workers checking for storm damage outside his parents' home.

Rep. Wallace Scarborough, 47, was charged with two counts of assault with intent to kill after he pointed a pistol at utility workers and then fired it Saturday night, according to a police report.

He was released from jail Sunday on a personal recognizance bond, according to jail officials.

Two South Carolina Electric and Gas employees had been checking electric equipment at the home after a series of storms passed through the area, SCE&G spokesman Eric Boomhower said.

Scarborough's lawyer, state Rep. John Graham Altman, said Scarborough asked the utility workers to leave and when they told him they had a right to be there, the Republican lawmaker returned to the house to call police. On the way, the gun accidentally fired and a bullet hit the porch, Altman said.

One of the workers said the lawmaker shined a flashlight on the pistol and said, "You see what I have? Get off my property," according to the police report.

The workers left when the gun went off, the report said.

Altman said he wants the charges dismissed and an apology from the electric company. "I don't think it's against the law to fire a pistol into your own back porch. It's absolutely obscene to think that a judge would uphold these charges," he said.

It will be interesting to see how this plays out. It appears, though, in part to be another case of a gun having a mind of its own and firing randomly.
 
Probably had a cocked and locked .45... you know they go off with a hair trigger.

Wonder what his voting record on gun rights is... proabably abysmal.

Does anyone besides me have any problem with this?

"Assault with intent to kill" sounds a lot like attempted murder. And he's out on a personal recognizance bond? What are the chances that anyone other than a politician would be released on their own recognizance after beeing charged with two counts of assault with intent to kill?

Maybe not- he was one of the co-sponsors of H 3110:
A BILL TO AMEND SECTION 23-31-215, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE ISSUANCE OF CONCEALABLE WEAPONS PERMITS, SO AS TO PROVIDE THAT VALID OUT-OF-STATE PERMITS TO CARRY CONCEALABLE WEAPONS HELD BY A RESIDENT OF ANOTHER STATE MUST BE HONORED BY THIS STATE AND TO DELETE THE PROVISION THAT THIS STATE WILL ONLY HONOR OUT-OF-STATE PERMITS ISSUED BY A STATE WITH WHICH SOUTH CAROLINA HAS RECIPROCITY.

Sorry about the caps... it was capitalized on the website where I found it. Regardless of his voting record, confronting a lineman after a storm, while carrying a gun, with his finger on the trigger, was a stupid thing to do.
 
If I was on the power co. crew he might have a misterious power outage in the middle of the night that would take several days to figure out. rugerman
