South Carolina: The Attack on “Stand Your Ground” in SC Begins


Looks it looks like yet another politician is trying to get rid of "Stand Your Ground" and change it to "Duty To Retreat" in South Carolina. Just recently there was legislation in Missouri to change the laws there to "Duty To Retreat".

"In essence, H 4801 would require a person to retreat when attacked unless they are in a dwelling, residence, place of business, or occupied vehicle. In addition, if the person against whom deadly force was used had a right to be there, the person attacked would be required to retreat."

Not sure what you are referring to regarding MO. Except as it concerns retreat from a dwelling or from an automobile, or more recently, from private property owned or leased by by the defender, Missourians have had a duty to retreat since long before the James brothers started using self-contained metallic cartridges.

The Missouri proposal would eliminate the Castle Doctrine; it has not been enacted.

Missourians have long had a duty to retreat except from their dwellings and autos. Not too log ago the duty to retreat from private property owned or leased but the defenders.

The reporters' comments are atrociously imprecise.
