Scope rings for Marlin 17 and Tasco 40 mm scope

I just purchased a Marlin 17 HMR and a Tasco 3-9x40mm scope. I'm trying to use the rings which came with the rifle but am having problems with the scope interfering with the rifle bolt.

I'm thinking I need higher rings. I've looked at Cabela's and they sell 3 sizes of Weaver rings but I'm not sure what size I currently have - they don't appear to be marked anywhere on the package or rings themselves.

I've searched the internet for Weaver and rings but there is so much to wade through that I haven't found the information I need.

Any opinions or ideas?
 
How tall are the rings you currently have(from the base of the ring to the "cradle")? Someone can then compare and make a suggestion. My guess is your rings are short, and you should probably only need to go up to a medium ring to clear a 40MM bell.
 
Thanks for the replies everyone. Looks like my current ones are 3/8" in height from the barrel to the bottom of the ring. 5/8" would probably be about right. Possibly 1/2" but...

Tom: Which model did you get from BKL Tech?

Mike- Its in the basement, in the safe... Its the one with the mount & rings in one unit, mount clamps to dovetail about3.5" on each side.

Just a wild idea here, maybe you might move the scope back toward the butt of the rifle. If the interference is due to the eyepiece you might get enough room that way. Don't worry about keeping a lot of eye relief with a .17 cal, as it doesn't have very much recoil.

I have my own Marlin 17 scope set back to where it would be dangerous on a 30-06 but I can't detect significant recoil related problems. At least I don't have a black eye yet. ;)
