Self Defense?

(This Story is completely fictional, and is being used to obtain different points of view/answers.)

Lets say you just get out of the movies with your girlfriend in a shady area… You notice as your going to your car, a few men are approaching you. You can clearly see they have knifes/bats and are threatning you as their coming your way…. You do not have a permit to carry, but you do have your rifle and ammo in your car….. Would it be legal to engage the men heading towards you if you knew they were to harm you? Or would it be illegal to take the gun out of the car without the license to carry a firearm?
 
It is not illegal to take the gun out of my car in Oklahoma provided it was being transported within compliance in the first place. That would of course require it to be with the action open and unloaded so I would have to load it first. However, if you have that kind of time, you probably have to time to get in your car and drive away, which is a smart move if your wife or girlfriend is with you.
 
Hmmm.... very true, but if you did choose the one over the other I wonder if it would be classified as self-defense?
 
since any firearm that is in my car is loaded, even if in the trunk, it would take me less time to grab a ready weapon than it would be to get 2 people in the car, start it and drive it away
 
Not to mention you would probbaly have to put it in reverse first.....and be nervous as hell...
 
You can pass all the dumb laws in the world and they should never supercede common sense. If my life were at risk, I could care less what laws said.

If my most effective choice would be to pull my AK out of my trunk, you bet I'd do it and defend myself. At least I'll live to show up in court, which is more than can be said for the thugs if they choose to advance.
 
I only have one thing to say. If theres more than two, aim for high chest, between the blades.
Try to fracture the spine. Just as lethal as a head shot, less chance of missing entirely.

12 or 6, its your choice.
I suppose with your girlfriend involved, it becomes 12 or 12...

Obviously though, if theres time just drive off. With a car like mine though, it needs to warm up or itll stall, so its not really even a choice for me.

Why woud I be nervous? I've got several feet of metal between me and them, and moving pretty darn fast to boot. If given the choice between gun vs. knife and car vs. knife, I choose car any day.

Us country boys can drive in reverse real well. It's be like redneck bowling, except my bowling ball say Ford on it, and the pins were armed.

if your ford is anything like mine, it would have a real good chance of breaking down in the 30ft drive it took to hit your attackers...
 
If it's faster to get to your rifle than to start your car, and you have another person with you, I'd

1) open trunk, grab rifle, get ready to engage
2) at the same time, have the other person get in and start the car
3) cover your rear while you get into the car (backwards if necessary - seatbelts don't matter in this situation) and get the hell out of dodge.

The gun should stop them from coming closer to you (or cause them to flee), which should buy you time and allow the other person to start the car, for you to get in, and to get the hell out of dodge. If it doesn't give them pause, you'll be ready to lay down some fire.

Best case scenario in any self defense situation is you get out a live, without having to fire a shot. This should be your first choice if at all possible. If not, the next best thing is to stay alive by any means necessary, even if it means killing the aggressor.
 
If you pulled a rifle out of your trunk, I can guarantee a bunch of outgunned scumbags would run. Have to remember that they are coming at you with numbers because they are cowards. Anything that gives you the upper hand will make them fill up their pants and run away.

Definitive answer: It depends.

It depends on which state you are in.

It depends on if you are slow enough to take your girlfriend AND new car into a seedy area to see a movie (that can probably be seen in a better part of town).

It depends on your intention. Are you there to provoke an encounter? Sounds like it. That alone makes it illegal in any state.

So, it depends.
 
You're facing imminent grave physical harm and have multiple effective tools to deal with it ... and you're fussing over guesses about words on paper written by people you don't know?
 
Your Cars bumper can be used just as accurately as a firearm. just saying. As youre fleeing, as is your duty in many self defense cases, if some of the bad guys try to stop you, by getting in your way, then well, by my book its suicide by chevy, not colt.
 
The first reply to this thread was really it. You shouldn't need to ask when you "get" to use your gun. Use your gun when you have no other choice.

Would you be comfortable sitting in front of a jury explaining to them why you had time to dig a rifle out of your car but not time to just drive away?
