This should not be misconstrued to suggest that the seller of a gun has any duty to determine whether the buyer is legal in any way. Had this kid sold the gun to a stranger who was a felon and used it the same way no charges would have been filed against the kid.

"10 years is a long time in prison, and will cost us probably more than the harm that would probably have resulted from this action."

His buddy used the gun to shoot two police detectives, one of whom died. That seems like a lot of harm to me.

Tim

we recently had a case in MN where a felon only 6 months out of jail was walking down the middle of the road when a police officer pulled up next to him and told him to get on the shoulder. Felon pulled out a gun and started shooting.

He failed to hit anyone.

He was given 5 years for the shooting and 3 years for having the gun. The sentences were to run concurrently or whatever the term is where you serve them both at the same time, rather than 5+3=8

It is absolutely assinine that a person with an otherwise clean record would get more time for GIVING a felon a gun than for the felon to HAVE the gun

Special Agent in Charge Brandon stated, "ATF’s number one mission is to reduce violent
crime;

One would think that falling under the Treasury Department, job one would be ensuring the collection of taxes. Whatever happened to the good ol' revenuer?

assinine is comparing to very different examples in different states seeking some kinda equivalency. the doofus that sold the gun KNOWING it was used to further a criminal enterprise is lucky not to catch accessory to murder

Sherman admitted that he gave Postley the shotgun to
help him “hustle,” which Sherman described as selling drugs or making money in other ways.

The ATF or BATFE is no longer part of the Treasury Department, and they no longer deal with the taxation of alcohol or tobacco.
As of 2002 that is done by the TTB or Alcohol and Tobacco Tax and Trade Bureau.

The ATF/BATFE was transfered from the Treasury Department to the Justice Department under the Homeland Security Act of 2002 starting in 2003.
They are now solely a LEO branch, not a treasury Bureau.
The A and the T of BATFE are just kept to keep from calling them the "Firearms and Explosives Bureau".
Thier almost sole role now is the enforcement of gun control, lending occasional assistance on explosives related cases, but even those are primarily dealt with by the FBI.
So they would be better called the Firearms Bureau.

I imagine that would sound too anti-gun though. So they keep the name long and meaningless. Toss in something about Tobacco and Alcohol for good measure. Throw in "Explosives". An viola you don't sound like a purely anti 2nd Amendment agency.

They do assist in explosives and arson cases, but the FBI is the workhorse on those.
They mainly deal with gun control. Anything related to guns or gun control or the application of gun laws.
