Hi all,

I'm from Tampa and will be in Atlanta next weekend and thinking about visiting the National Arms Show this weekend. I have a couple guns I might like to sell. What are the rules around this?

Thanx

Handgun or long gun? You'll need to use a licensee for the transfer.

Unlicensed Persons Questions

Q: To whom may an unlicensed person transfer firearms under the GCA?

A person may sell a firearm to an unlicensed resident of his State, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may loan or rent a firearm to a resident of any State for temporary use for lawful sporting purposes, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may sell or transfer a firearm to a licensee in any State. However, a firearm other than a curio or relic may not be transferred interstate to a licensed collector.

[18 U.S.C. 922(a)(3) and (5), 922(d), 27 CFR 478.29 and 478.30]
Q: From whom may an unlicensed person acquire a firearm under the GCA?

A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee’s premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes.

[18 U.S.C. 922(a)(3) and (5), 922(b)(3), 27 CFR 478.29 and 478.30]
Q: May an unlicensed person obtain a firearm from an out-of-State source if the person arranges to obtain the firearm through a licensed dealer in the purchaser’s own State?

A person not licensed under the GCA and not prohibited from acquiring firearms may purchase a firearm from an out-of-State source and obtain the firearm if an arrangement is made with a licensed dealer in the purchaser’s State of residence for the purchaser to obtain the firearm from the dealer.

[18 U.S.C. 922(a)(3) and 922(b)(3)]

I'm selling an XD-Sub9c, Taurus PT92, and maybe a Remington 887. Can I buy a gun at this show also?

See CoRoMo's post. You can purchase a gun at the show, however, the seller (private or FFL) has to ship the gun to a FFL of your choice in Florida, where you will then fill out a 4473 form, pay the transfer fee, and then take possession of the gun. You can also sell a gun at the show, if a FFL at the show is willing to do a transfer (buyer fills out a 4473 etc).

*note: this is how it works with handguns. I'm not sure if long guns are any different. Someone else can hopefully give this info.....

You can sell any gun to a dealer, but not to a non-licensed individual. (Unless you are transferring it to them through a dealer there at the show.)

You can purchase a rifle or shotgun from a dealer and take it home with you -- as long as all laws of both FL and GA are followed and the dealer agrees to do the sale (they don't HAVE to, but can).

If you want to purchase a handgun, you can, but as Brian said, you can't take it with you. It will have to be shipped to a dealer in your state and you'll have to do the transfer paperwork there. Usually this involves both a shipping fee and a dealer transfer fee adding something between $50 and $100 to the total cost.

so it would not make sense to buy (yet another) handgun out of state. I mainly wold like to sell the XD but a dealer will certainly take less than an individual would I suppose.

Thanks for the responses - I'm mainly looking to kill time this saturday before I pick up my friend at ATL.
