Shipping from California to another state

OK, I've searched this site, CALGUNs, and even the California statutes, and no one seems to have any definitive answer to this question:

If my brother in California wants to transfer his hand guns and long guns to me in Florida, can we just go down to the local FEDEX in California and mail them to my FFL in Florida, or must an FFL in California also be involved?

If someone has done this, please advise.

Obviously, he can't transfer ownership to me in California, since transfer of ownership has to go through an FFL in California, and that can't happen unless i'm also a California resident. Isn't there also a waiting period, even for transfers between individuals?

First, I'm assuming that you're a Florida resident (or if military that your permanent duty station is in Florida).

So first, of course you're correct that the guns will need to be transferred to you by an FFL. You may not take possession directly.

Second, it is legal for your brother to ship them himself to your Florida transfer FFL. However, some FFLs will not, as a matter of business practice, accept guns for transfer from anyone other than an FFL. You will need to check this out with your transfer FFL and see how he wants to handle things.

Third, handguns may not be shipped by mail, except by an FFL. If your brother ships the handguns directly, he will need to use UPS or FedEx and abide by their requirements.
 
California law would not have anything to do with weapons leaving the state. No FFL in California would have to be involved. Your statement "If my brother in California wants to transfer his hand guns and long guns to me in Florida, can we just go down to the local FEDEX in California and mail them to my FFL in Florida, or must an FFL in California also be involved?" would be correct.

However, it might actually be less expensive to ship them through a California FFl who can ship by USPS a lot cheaper than you can ship through FEDEX.
 
It is up to the individual FFL dealer on if they accept shipments from private parties or from FFLs only.

You need to find out from your FFL dealer on if they will accept a shipment from a private party.

This question isn't about the FFL on the Florida side. I just need to know if my brother (or me, since he's sick) can just ship via FEDEX in California to FFL in Florida without involving an FFL in California. From what I think I've read, "transfers" in California have to go through an FFL, but in this case, there is not transfer until the guns arrive at the FFL in Florida. It also looks like some FFLs in California could charge a lot of money to transfer several guns. In Florida, it's usually one price for a transfer/NICS check, regardless of the number of guns involved.

[1] This is not a California transfer. It's a transfer in Florida. And it needs to be done by an FFL because of federal law. California law is not applicable.

[2] And did you not understand what I wrote? Whether or not the Florida transfer FFL will accept guns sent to him directly by your brother is completely up to the Florida transfer FFL. You need to check with him.
 
Yes, you can.

But ...

Since an FFL can ship via the USPS, and you can not, it might well be much less expensive (as in 1/2) to pay a service fee to an FFL to do the shipping for you.

That will also resolve any Private to FFL issue on the Florida end.

In general there is no *requirement* for an FFL on the CA end. As has been pointed out, it might be cheaper to pay an FFL and have him mail the handguns to FL than for you to ship them Fedex Overnight.

You should be careful about restrictions on CA residents transferring high capacity magazines or "assault weapons".

It is unlawful for any person to manufacture, cause to be manufactured, import into the state, keep for sale, or offer or expose for sale, or give or lend, any large-capacity magazine. (Penal Code §
12020(a)(2).)

It's not clear how this law affects transferring the offending magazine out of state.
 
Also, if you do not have a CCW, there is a three day waiting period for handguns in Florida
On the purchase of a handgun.....790.0655(1)(a):
There shall be a mandatory 3-day waiting period, which shall be 3 days, excluding weekends and legal holidays, between the purchase and the delivery at retail of any handgun. “Purchase” means the transfer of money or other valuable consideration to the retailer.
. . .
The OP's situation is not a purchase...no waiting period.
