Just as a heads-up to our N.E. Arkansas members, KAIT-8 has a series of stories showing shoot/don't shoot scenarios. It seems to use the Jonesboro P.D. as the experts in the situations, so you may want to take what is said with a grain of salt.

That said, I'm very proud that KAIT is taking the initiative to inform the general population of possible scenarios and their repercussions.

Actually you might want to take note with seriousness exactly what they say, this will give you a look into just how they will investigate any citizen/deadly force encounter and just what they will report to the DA for prosecution.

If you fall into this jurisdiction you might want to pay more attention that to just take it with a grain of salt.
 
The first two scenarios

Okay, just watched the two scenarios that were aired. Will have to wait 'til the 10 o'clock news to get the answers.

A couple of observations: The situations were very sketchy. The first consisted of a burglar in your house as you are getting home. You notice the front door slightly open. You were sure you locked it this morning. You get your handgun (not even a passing nod to ccw or not, actor pulls handgun from glove compartment). The burglar emerges from the front door. Shoot/Don't Shoot.

The second had a knife wielding intruder breaking into your house while you are home. You hear the noise of the break-in.
(Here's a quote that absolutely steamed me: "Instead of calling the police, you decide to take matters into your own hands." I got so upset at that, I had both of my parents laughing at me.)
You grab your handgun and wait for the intruder. Shoot/ Don't Shoot.

As I said, these were very sketchy scenarios. Either could swing either way depending on further details, as I'm sure you can see.

But at least they're trying, I suppose.

FW, good point. I thought of that myself but didn't think to include it. Mostly I was just remembering an account I've heard about JPD hassling a legally carrying citizen. That particular event took the state police stepping in to get it lined out.

First one you are outside, he's inside comming out no weapons issue a challenge but until something else happens to place you in fear of your life its a no shoot


Second, armed and in your house regardless of how and why you arrived at that moment, shoot
 
Georgia and Oklahoma must have similar laws. FederalistWeasel nailed it on both counts for here.

RE: the first scenario...
The Felony pointing of a firearm law makes it a felony to point a weapon at a person except in some very specific cases one being that you can do it to protect your property. What's weird is even though you can point a gun at a guy who is for example stealing your car or as in the example scenario leaving your home with an armload of your stuff you cannot shoot him (I'd guess the odds are that the BG doesn't know that though). In addition in OK there is a misdemeanor pointing of a firearm law that makes no exemptions what ever. So technically I guess an OK DA could charge one with that crime if he/she wanted if the property owner pulled a gun on a BG in the act of leaving one's home.

Re: the 2nd Scenario
The OK law is specific. Blow him away. Is that the right thing to do in every instance? Probably not. Legally though if someone enters your home unlawfully he's putting his life in your hands.
