Silencers: legal in Missouri?

Actually you can own silencers in MO now, well at least according to Missouri Law HB 2034, they are. The law signed in effect AUG 28 last year allows them to be owned by any FFL holder. I got my C&R ffl and purchased my suppressor about a month ago. SBR's and F/A have been legal the same way for quite some time now.

Please excuse my ignorance, but what is C&R? Do you have to maintain your FFL in order to keep the suppressor, or can you get a FFL, get your suppressor, and then not keep up your FFL? Is there some place where I can find out exactly what is required to own suppressors for MO residents? Sorry for all the questions, but I've been wondering about all this for a while now.

As others have mentioned, silencers are legal to own by FFL's in Missouri. However, what has not been mentioned is that the silencer must be a "curio, ornament, or keepsake." You can't just get a C&R license and then make a homemade silencer or buy a brand new silencer.

SECTION 571.020

This act allows licensed importers, manufacturers, dealers, or collectors to possess, manufacture, transport, repair, or sell a firearm silencer as a curio, ornament, or keepsake.

Currently, it is not a crime for a person to possess, manufacture, transport, repair, or sell a firearm silencer if such action was incident to dealing with the silencer as a curio, ornament, or keepsake, or it is used in a lawful dramatic performance, but only if the silencer is in a nonfunctioning condition. Under this act, the silencer would not have to be in such nonfunctioning condition.

If the law is going to allow a person to actually make a silencer, then it obviously does not have to to be a real curio (antique) to be made or bought by the C&R holder. The C&R license is a federal license for those people who want to collect antique firearms. It is not a dealer's license, but can be used to buy from those across state lines. While an FFL can not be used to accumulate a personal collection, this is the purpose of the C&R. http://www.cruffler.com/

The verdict is you have to be a FFL holder to own a silencer in Missouri. A C&R license is considered a FFL so you have to get your C&R license first before getting the suppressor. The steps are as follows:
1 Get a C&R License - it costs 30 dollars and will take a few months to get, here is a good website that goes through the steps - http://www.surplusrifle.com/shooting2005/howtogetyourcurionrelicffl03/index.asp
2 Go to a dealer that sells suppressors and find suppressor you want and buy it after you show your C&R license to your dealer.
3 Dealer gives you a form 4 to fill out along with passport photo, fingerprint cards, and signature from your LEO. You send all of this and $200 to ATF, then you wait a few months
4 You get the tax stamp back, dealer gives you the suppressor, you are done.

Like I said before a few months back, you need a ffl to get a silencer, but a C&R counts as a FFL, so you must get your C&R then fill out a form 4 to get a silencer. Once the the form 4 gets approved with tax stamp you can buy one.


If you're in St. Louis area, go to C&S metalwerkes, they have plenty of silencers available for under $1000.

Jeez, it never ceases to amaze me how many people who don't know what they are talking about chime in with wrong info. Daskro has described, in a nutshell, what you have to do in Missouri to get a real, live, functioning, silencer. This has been the law in Missouri as mentioned by Anthony White since Aug 2008.

Yes, they are legal in Missouri. I thought about getting one for a certain gun awhile back but couldn't justify the cost. IIRC it would have been around $900 all said and done. I just wanted one to shoot pests around my house......decided to buy sub-sonic 22lr rounds for a couple of dollars instead

Daskro is exactly right. It is a relatively simple matter for any of us who are not felons to legally own suppressors in Missouri.
