SKS California Question

Ok so first off I'll apologize for asking a question that has probably been answered many times here. I've read the posts about CA and the legal posts and all it's done is completely confused me. So I'll just put my question out there and see what you all say.

I'd like to purchase a Chinese Paratrooper SKS and I live in California. The rifle has a 16" barrel and is over 30" in length overal and has a fixed 10 round magazine, no grenade launcher. I want to keep the original spike bayonet on the rifle. I want to put a NON-folding pistol grip stock or perhaps a Dragunov style stock on the rifle. I'd also like to put some type of CQB sight on it (Eotech or AimPoint). The stock and sight are the only modifications I would plan on doing.

Would this be both California and Federal legal?
 
Since it has a fixed ten round magazine, the assault weapon rules won't apply so you can have a pistol grip. There are no federal rules anymore and remarkably enough California does not see the evilness of a bayonet or bayonet lug and it does not apply to assault weapons in the state or a 10 round fixed magazine SKS which also is beyond the AWB.
 
The problem with modifying an SKS is due to the federal import regulations. Depending on how the particular rifle was imported there can be regulations that prevent you from modifying the rifle from the status that it was imported under. I am not familiar with how the Chinese SKSs were imported, but I would check around on the various SKS boards just to make sure what you want to do is kosher.

Technically the sks's that have bayonets are C&R rifles. The chinese rifles were never C&R so they really aren't suppose to have the bayonets attached per federal law , california doesn't care. I think there is a 1989 cut off point where if the rifle was imported before then the bayo is ok.Now there alot of chinese rifles with the bayonets out there so I guess it is up to you. Without the bayonet your rifle would be totally legal. As for the stocks I don't think any are made with the bayo slot so you would have to cut one in them. Mark
 
As I know you able to buy here in CA Russian SKS with bayonet. But it will be illegal to switch to Dragunov stock. Sorry, you should follow state rules, even everybody understood - it's stupid rules.
For example limitation of 10 rounds. I can change clips in less than 4 sec. What kind of advantage for person of 2x15 clips, who can change it for 10 -12 seconds and me with 3x10 clips?

Would you explain why it would be illegal to switch to a Dragunov stock? The evil features rules only apply to centerfire rifles with detachable magazines. The SKS has a 10 round fixed magazine so the evil features rules do not apply.

Also how do you change your clips in 4 seconds? Do you mean magazines? There is no limitation on ammunition clips. The sks has a fixed magazine and you can load it by using clips. You do not change clips unless it is a M1 Garand.

Now the federal import laws are something else I am not familiar with and would require some more research.
 
A dragunov stock on a russian sks is legal without the bayonet. The russian rifle was imported as a C&R rifle so the bayonet is legal. When you put on the dragunov stock it makes it so it is no longer C&R. Even though it is no longer C&R it would be importable as sporting rifle. This is per federal laws. Mark
 
California Question

The problem you have(a couple of them) The Chinese rifles can't have bayonets. You can't put on a pistol grip stock or Drago style because a rifle can only have 1 "evil" characteristic. You would have to cut off the bayonet lug to use the stock. "Evil" characteristics are bayonet lug,detachable mag(for centerfire rifles) or a fixed mag over 10 rounds, a pistol grip or thumb hole type stock, flash reducer..muzzle brakes are OK.
 
The sticky point on SKS's is the detachable magazine or not. I think there was some edict that all SKS with detachable mags were supposed to be turned in in 2000.

Course this is not something I have confirmed as its not relevent to me so take it with a grain of salt is was gun shop banter.

I find half the gun shops are way on the safe side. not that I really blame them, unless they treat me poorly...
 
Since I got my C&R license and started getting dealer flyers, it seems almost everything is marked "Not For Sale In CA."

You guys can barely own anything neat.:(

Well, I know that much is not true, but I'm not sure about the pistol grip. I do know that only SKS's with fixed 10 rd mags are legal here; detachable mag SKS's are verboten. You might try reading through this crap http://ag.ca.gov/firearms/ and see if you can get an answer.
