Suppressor Purchase. Can I Submit Forms Myself?

I recently purchased a suppressor from a local shop. It was in stock and I paid in full. I created a trust to have the suppressor transferred to. I provided the shop with the trust document. I was told that the shop owner would have to complete the "paperwork" and they would call me when it's ready. They didn't ask for the tax stamp payment at that time.

It's been two weeks and I still haven't got a call from the shop owner. I've left 3 messages and was told each time that the owner would call me back. But it hasn't happened. My question is there anyway I can complete and submit the "paperwork" myself? If so, what needs to be submitted?

I'm frustrated because I've paid the money for the suppresor already add well as paying an attorney to draw up the trust and now the process is stagnant before is even gotten to the feds.

Yes, and in my opinion it is preferable as you know when it was submitted.

Go back to the store in person and get your money back. You are being jerked around for some reason.

P.S. You gave the dealer a COPY of the trust, not the original, correct?

Yes, I gave them a copy. I kept the original.

In doing some research, it looks like I need to complete a Form 4. Is that correct? Is that all I need to submit?

Some seller info is needede and they need to sign their part. The last can I did last Friday I did not have my checkbook on me and they completed and signed their part and I mailed it myself Monday morning.

Unfortunately you cannot do the form 4 alone without their cooperation.

Understood. But if I can at least complete everything else, I can at least take it by the shop and insist that they complete their second.

And since I'm using a trust, I assume that I should fill out the form 4 with the trust's legal name and not my own?

Correct on both counts. They do not pay the $200 tax, so none of their money is involved. And they already have YOUR money for the suppressor. You can always "insist" that they complete their part, but you might simply let them know that if they don't fill out their part so that you can submit it, you will ask for a refund and take your business elsewhere. At this point they have nothing tied up in the can; it is all yours. And since you couldn't even take possession without the stamp, they can't complain of a 'restocking fee' or somesuch as long as it wasn't ordered specifically for you.

Thanks fellas.

I think I have everything taken care of. I printed off 2 of the Form 4s and completed everything except the dealer sections myself. I went to the shop today to get the dealer signature and FFL number. The owner came out and looked over the forms and said she'd have to take them to the sheriff's dept first. I politely corrected her and said that since I'm using a trust, there was no need to take them to the sheriff's dept. She was like alright, leave them here and I'll have the sheriff look them over and then I'll mail them for you. So I politely said no thanks, I just need your signature and I'll mail them myself. She did and so I sent the 2 Form 4s, the citizenship form, a copy of my notarized trust document, and the check off just now. Hoping I didn't forget something.

The owner is so misinformed she must not be the holder of the NFA Dealer's license. Next time you're in there, find out who it is and deal only with that person.

Based on the runaround you received and her ignorance, you should find a different NFA dealer.

No, she is definitely on the FFL as the owner. I saw a copy of the license. They are actually a very large company in the AR sector and happen to be local for me. They are pretty much the only suppresor dealer within an hour of me.

There are plenty of SOT's that don't have a "brick and mortar" store. You may be surprised what you find. http://fflgundealers.net/

I have a dealer account with this particular store, so I used them in order to save a considerable amount of money on the cost of the suppresor.

You may have saved some money, but what's your time worth having to deal with all this run-around? I would still find a new dealer for any further transactions.

And can you be sure they will call you when they receive the approved form back from BATFE? :scrutiny:
