Teen "Sniper" pleads Not Guilty

If we are going to discuss legalities here, has anyone here at THR read anything in the media that mentions that the alleged shooter had a parent or guardian present for meaningful consultation during the "interview" with police?

I have not. Maybe the "confession" can be attacked?

I haven't read anything about a parent or guardian being present at the time of questioning. I'll put a nickle on it that it wasn't his grand mother since she was arrested too:D

Just a question, but where in Indiana is there a deer season that runs in July?

Every story I've read recently references this loser on a "hunting trip" with "family members."

One story I read referenced an argument over "gutting a deer."

Are there such things as July deer seasons in Indiana?

Who wants to bet he will try to use "The Devil Made Me Do It" defense at trial.

I'm willing to bet various unscrupulous people (including a certain Miami lawyer) will try to blame this on video games, like they did the Washington "sniper" murders.

Shame he confesssed. Wonder how soon he will refute the confession! Since we have some good laws already, this will not stop until killers get what is coming to them and that will only happen when the courts are cleared of the poor judges by whatver means necessary. Ask me if I have any more opinions :D .

All that is necessary in most states and under federal law is he be offered the opportunity to consult with counsel prior to questions being asked. If he doesn't ask to consult with counsel or with his parents, the interrogation can continue.

He confessed and then pleads not guilty? It'll be interesting to see on what grounds.

He's obviously another damaged soul--sad to see. Living with his grandparents, you know things haven't gone as well for him as you'd like to see.

No excuse for his actions though...there's a lot of folks that have had it tougher that haven't gone sniping people. 2 hours between incidents? Kind of takes away the "heat of the moment" argument, doesn't it?

There are times where the deer population grows to the point where it's unsafe. In these situations State Parks will let in some hunters to thin out the deer population. As far as I know Indiana permits only shotguns, handguns, muzzle loaders, and bows.
He did it because he wanted attention. When the dust settles, he'll get a whole lot more attention. I wonder if he's ever heard of this saying "Be careful what you wish for, it might come true".

Phenom

He'll definitely use some form of "The Flip Wilson Syndrome". As everyone knows the person doing the evil is never responsible, someone or something else always is.

Absentee parents another 60's byproduct. A big, burly kid living with his grandparents. No dad around to beat some sense into him.

He certainly could have been deer hunting in Indiana with a rifle. They have crop damage permits available for landowners. And you can use them, as long as the landowner permits you to. And you can use rifles for this. At least that is my understanding of it.

I don't know about IN. but in Michigan The DNR issues crop damage licenses during the summer months.
It's not deer season and you can't hunt deer with a rifle.
Also in MI as I understand it rifles can be used for crop damage permits even though during regular season it is shotgun only in the lower 1/2 of the lower peninsula so it's possible IN. has the same provision.

You know? The Devil has made me do all kinds of things, but each time it was I who did them.;)

And if there wasn't a lawyer or at least a guardian present durring his confession, then it is going to be as useful as toilet paper once the defence attorney gets ahold of it.

By beating sense into a child you're teaching them violence is okay. The only time violence is okay is in extreme situations like your life is in danger.

I would argue it's simple negative reinforcement. Do something really stupid? BAM! Do you do it again?

How many of our fathers would have beat the living daylights out of us if we fired a rifle at a car? (raises hand) ...whatever happened in the young man's upbringing, something was left out. He clearly did not have a firm grasp on reality and failed to weigh the consequences of his actions. I am willing to bet this could be correlated with a lack of discpline growing up.

Perhaps beating is to strong of a term here.

But, I guarantee you my kids learned a lot more fom a smack up along side there head when warranted, than by a nice non-confrontational discussion.

We had discussions, but they also had their heads smacked when I felt immediate negative reinforcement was warranted.

And guess what. both of them grew up to be fine citizens of the world. In fact, as far as I know, they never randomly shot anyone.

For this kid, there seems to be a total lack of teaching regarding personal responsibility. His attention getting behavior is about to pay very big dividends.

Psy 101 on reinforcements and punishment

Reinforcements= something pleasurable to the person given to maintain or increase a target behavior (a reward). Types= positive... (candy, $, or whatever the subject likes)... negative reinforcement...taking something adversive away(which results in giving pleasure to the subject (if you finish your term paper I'll take your homework assignment away).

Punishment= anything adversive given to decrease or stop a target behavior.

Many educators think the ratio of rewards to punishments should be about 10:1, but I've come to believe that is just because of their mostly liberal agenda and think that good sound discipline/ punishments play a large part in child development, too.

No I haven't, but this moves beyond the guardian present upon police questioning and he should've exercised his miranda rights, waiting for his attorney. It probably doesn't matter much anyways. The police have the murder weapon and he was in possession of it, or at least has his fingerprints all over it, right?

I live in Indiana

27 miles north of seymor. no high powered rifles allowed even on your own property when deer are affecting the crops this guy according to the police reports shot from an over pass .. the verdict is not in yet! Last time I checked you can't hunt on a road. IMO A death shot in the chest, a shot to the head and a few other shots that struck vehicles traveling on I-65, and I-69 all that happend within 24 hours.... this is no accident although the suspect could wrong. I have hunted what are odds that several stray shots could do this. A HUNTING ACCIDENT IS UN VIABLE AND UN RELEASTIC.

My dad drives an 18 wheeler for 33 yrs. I worry about psycopathic people like this.

I can not say they have the right person, or not, but this is no accident..PERIOD..:cuss: :banghead:

They always say what a good boy he was:

Kenneth Shipley, 59, a family friend who lives in Gaston, said he was also surprised.

“This isn’t the Zach I knew,” he said. “I took this real hard. Zach just needed some attention, someone to talk to.”

I bet he'll get that attention and someone to talk to... in prison.

I always respected and sometimes feared my father more than the legal authorities. He always said
"never start a fight , but always finish it" and "if you ever get in trouble with the police you are going to wish they had kept you in jail."
"Take responsibility for your own actions and being drunk is no excuse."
I think that sums up what more children need to be taught today.

Since seeing this story I have been wondering…. Is 17 a juvenile in Indiana? Because it’s not in Illinois.
