Here's a guy who writes about receiving a pistol in the mail in California. Maybe monday he will write about his experiences with the legal system. I wonder if he is niave, left out some facts (FFL), or if he's intentionally inviting a conviction as part of a series on the encroachment of the second ammendment.

"Special Report
Col. Denman’s Luger Print Friendly Format
By Ben Stein

BEVERLY HILLS -- A few days ago, a package arrived in the mail from the widow of my late father-in-law, Colonel Dale Denman, Jr., of Heber Springs, Arkansas. I opened it and there was a leather holster and inside it, a German Luger pistol. My father-in-law had taken it from a captured German officer in early 1945 and kept it for almost sixty years. He had left his wife instructions that I was to get it...."

Wow Ben Stein

Hes uber smart. Technically he might be breaking the law. Maybe the ATF will raid his house seize the gun from his night stand get him convicted and take his gun rights for life.

Well if it was bequeathed to him, isnt the gun legally his property? The transfer happened out of state and he shipped the gun to himself in CA. Isnt this legal? The law only says that _transfers_ have to go through an FFL. If you take your guns out of CA, do transfers and come back in, there is no need to follow the stupid CA laws.

Also, the luger doesnt violate any CA laws on magazine capacity, etc.

Looks Good to Me.

First of all, this is a willed item to another person, upon his death. Per GCA 68, this is a permit activity. A FFL is not needed because this is an exception to inter-state transfer of firearms. Since 1968 willed firearms have been transfered from lawyer to lawyer, for their clients, all over this country. Ben Stein is a lawyer. No problem. Anyone who can own a firearm, can pick up a firearm willed to them, anywere in the USA, and return home without having to go through a FFL. Depending on your home state law, you may have to register it with your state or local authorities. All other Federal Laws must be followed

Mailed? If he ment going UPS or FedEX that would also be ok. Again GCA 68 would allow this. FedEX and UPS might not wish to do this, but that is another whole matter. (Possibly just going from/to a lawyer with the discription of "Legal Matters" will answer all questions)

Do not know the current law on USPS mailing of handguns. Mostly it is not allowed, but there are some exceptions.
