When you find out, let me know..
I didn't believe what I was reading at first. A gun dealer
could be fined ANYWHERE in the U.S for a gun used
in a crime ?

Yassky has authored a bill that would direct the city to fine any member of the gun industry—in New York City or out of state—$100,000 for each violation of a code of conduct designed to protect New Yorkers from illegal firearms. Among other stipulations, the code of conduct would put a cap on the number of guns being sold to one person

not that nuts

Well, but still pretty nutty.

They sure are determined to "take the fight" to the rest of America:

Yassky authored a similar bill last year that would allow the city to sue those gun dealers and manufacturers. The council passed it and Mayor Michael Bloomberg, who has spoken out strongly against illegal gun trafficking, signed it. However, the U.S. Congress, which is currently Republican-controlled and in favor of gun rights, recently overturned the bill.

"We did it already and then Congress overruled all the local and state laws," said Yassky. This time, the bill was crafted to avoid possible overruling from Congress. It charges the irresponsible gun dealers and manufacturers with a civil penalty rather than suing them like the last bill, he said.

"We are absolutely determined to protect ourselves [from gun violence]," he said.

Is this the "new loophole?" I guess loopholes are OK when it is your side that pushes them . .

David Yassky is an anti-gun fanatic in the strictest sense. Apparently, he’s also a very bad lawyer if he thinks he can pass a local law that applies to people outside his jurisdiction and can’t be overridden by Congress.

In other states with lax gun laws, such gun dealers are responsible for 9 out of 10 illegal guns that maker their way into New York City.
They either just make that up or got it from NYAGV, who just made it up. Not only is it an impossible stat to prove, it’s an impossible stat to collect.

Two anti-gun-owner lawyers think NYC is shooting blanks:

(article from last year)
excerpt
If GIRA Is A "Police Power" Law, It is Almost Certainly Unconstitutional

So suppose, then, that GIRA is not supposed to be a new tort rule; it is supposed to be a regulation governing conduct that includes a civil penalty provision. A new problem then arises, for the New York City Council has jumped out of the frying pan and into the fire.

Here's the problem: Municipal legislation which is designed to regulate conduct outside of New York State almost certainly runs afoul of the "dormant" commerce clause of the U.S. Constitution.

The Commerce Clause contained in Article I of the U.S. Constitution gives Congress the exclusive power to regulate interstate commerce. "Dormant" commerce clause doctrine holds that, as a corollary to the commerce clause, states may not regulate interstate commerce even in areas where Congress has chosen not to exercise its regulatory powers.

Among the restrictions on state regulatory power included in dormant commerce clause doctrine is a prohibition on state laws that have extraterritorial regulatory effects beyond the borders of the state. Thus, the State of New York may not enact a statute that restricts gun sales in New Jersey.

I thought regulating interstate commerce was exclusively the duty of the US Federal government?

The gun companies not based in New Dork should tell him flat out that he can go ["do something unsavory."]

If he had any sense, he'd be concerned about criminal violence.

To most of these lefties think gun-owner = murderer looking for a place to strike, gun-dealer = murder weapon supplier, and gun-maker = murder weapon maker. So therefore all of the above are the source of criminal violence.

Yes, this would definitely run afoul of the dormant commerce clause powers of Congress. Basically there is no way this legislation could stand... it would get struck down the first time it went to court.

it would get struck down the first time it went to court.

We hope.

If I was a gun dealer outside of NYC, I would send them a note in the mail, enclosed would be a picture of my middle finger.

I know it is wishful thinking but how about the gun manufacturers stop selling to the NYPD and other NYC law enforcement agancies. Don't service anything either. Screw them and their NEw YorkTrigger. Carry truncheons like the British Bobbies! Yassky is sure we don't need firearms!:neener:

NYC has a variation of the same syndrome that affects leaders of Red China. In the Chinese, it's called the Middle Kingdom complex-they believe that China is rightfully the center of the world.

NYC thinks they're the center of the world, and that world revolves around them.

china is the center of the world.

hell is in the center of the earth, right? china is hell. i have a love-hate relationship with china. i love it when i'm not here, and hate it when i am.

Simple solution...

other cities, mainly those with gun dealers affected by this idiocy, should pass local legislation that fines NYC councilpersons $200,000 every time they open their yapper.

One should be about as enforcible as the other....
