I'm planning to head home during thanksgiving. My bolt action is legal in NH and NYC. The catch is I have a bus transfer at Boston South Station. In this circumstance it seems that an unreasonable prosecutor would claim that FOPA doesn't apply. However, MA does have a grace period for registering long guns. Would that apply or is any possession of a rifle by a non-hunter/non-FID owner a crime?

The rifle would obviously be locked and unloaded in a hard side case.

Thanks,

"Nonresidents may possess rifles, shotguns and "ammunition therefor" without a license or FID while traveling in or through the Commonwealth, provided that the rifle or shotgun is unloaded and enclosed in a case. A nonresident without a license or FID may also carry or possess "conventional rifles, shotguns, and ammunition therefor" if the person meets the requirements for such carrying or possession in the state in which he or she resides. Persons in possession of firearms or ammunition who are moving into Massachusetts or returning to the Commonwealth after an absence of at least 180 consecutive days must obtain the proper credentials within 60 days of entry in order to continue to possess the firearms or ammunition legally."

Seems okay to me, does it not?

So long as its in a locked case and separate from your ammo.....you shouldnt have a problem....

heck, most people arent even going to know its a rifle....theyll probably figure its an instrument.

i had to transport my rifle case(empty) from boston back home.......and i had to take the train...

i was fully expecting someone to call the police on me, and end up in some big ordeal.....

on my way to the train, i walked past one police officer....and then another officer in the train station....neither one blinked an eye....

the train conductor didnt seem to mind either....

everyone in south station is busy with their own things....just dont act suspicious, and no one is even going to notice you.

So what you're saying is carry it loaded, with a shoulder sling, and continuously make furtive gestures and talk to myself. Is that more or less correct?

i think as long as you do that youll be all set........you might want to don your Shemagh and tape some road flares to your chest for good measure.

Hedge your bets and print out the appropriate laws governing the safe transport of longarms by non-residents of Massachusetts. Put the print outs in the gun case with your rifle. Massachusetts law enforcement is a real case of YMMV.

Amtrak, I assume?

You might want to check their policies. IIRC, guns on trains is illegal.

I'd say save yourself potential trouble and just send it UPS... ridiculous, i know, but it is a lot cheaper than a lawyer.

nah, busses. Guns on Amtrak was recently legalized, but only on trains with separate luggage cars... Both the NYC-BOS trains are non-luggage car trains, so guns are no go.
