Trust question

He's wrong.

You send a COPY of the trust. NEVER send the original.

And there's absolutely no reason to wait to send off new forms. He's wrong about that too.

Tell him an experienced NFA lawyer said so. He can e-mail me if he still doesn't believe you.

Some questions that have me puzzled with the recent changes;

1. I have my trust done (and realize that I fall under the "new" rules; only did the trust so I could have my wife and daughter as trustees). My first filing has to be a paper submission, correct?

2. Since my wife and daughter are trustees, I have to submit photos and fingerprint cards on all three of us, correct? How do I do that? Do they go on a separate sheet of paper? The photos won't all fit on one Form 1 or 4.

3. I go through this each time I submit a Form 1 or 4?

4. Does there have to be a Schedule A with the submission and does it have to have 'something' in it? (A friend said he listed a $1 bill as it has a serial number. ???)

Not until Wednesday.

Why would the rules apply to you earlier than they apply to the rest of us??

If you eFile, you send in a copy of your trust as an attachment, so they get it that way.

If you hurry, either by paper or by electronic filing you should be able to get items in before you have to do the fingerprints, pictures, LEO notification, etc.

However, the clock is ticking down fast. Got less than 24 hours here.

It depends on your state. If you dont know then include a schedule A ( Property list ) . Some states require them and some don't. Including a property list doesnt cause problems like not including one when your state requires it for the trust to be valid. It doesnt have to be a dollar. My first schedule A item is an NSA document safe. It could be your dogs collar for all it matters. It doesnt need to have a serial number .

Has anyone other than Yugo actually had a trust rejected by ATF for not listing assets?
Our shop has had trusts rejected because the Schedule A didn't list anything. At that point they told us they wanted that specific item listed on the Schedule A. I honestly don't know if this was just one examiner who didn't know what he was doing, or whether that's the way that specific trust was written (it's the trust most commonly used by our customers). All I know is since we started listing the current item the customer is buying on the Schedule A, none have been rejected for that reason since. Now, sometimes we get trusts that don't have a Schedule A, and those seem to work just fine, too. So I don't really know what the standard is, I just know what gets approved and what doesn't. After all, I'm not a lawyer.

Had no trouble getting my paperwork done and submitted this afternoon. Except that I almost didn't get out of the shop without also buying an integrally suppressed 10/22.

I have no reason to send in a Form 1 or 4 at this time. I was asking about what will happen from now on. Thought it was a simple question, but I have my days.

1. After tomorrow there will be no more e-filing since they don't allow uploading fingerprints (currently).

2. Yes all three have to submit fingerprints and photos. And I believe it's triplicates now (two for ATF one for LEO) Don't know about how to attach them.

3. Yes.

4. Depends on your Trust wording/ State, but probably yes you need to include it and I would go ahead and put something in it to be on the safe side.

Thanks! That helps.
