does anyone know if this applies only to tx residence, or anyone legal to own firearms? i've read it a few time but can't find anything about residency. i live just north of the tx border and drive to southeast dallas area to pick up my oldest son. i have to drive through very bad areas. i did breakdown at c.f.hawn and pine ave(near malcom x blvd) once and no tow company would come to help! very bad evening indead, compounded by the fact i had my pregnant wife and 3yr old son with me. knowing about this law makes my feel better, but i want to be sure. oh yeah, i will be getting a chl soon. thanks for any imput.

1) It does NOT apply only to Texas residents, it applies to anyone here who is "not engaged in a "criminal activity", as the law says specifically.

2) The person is assumed to be able to possess firearms or they would be engaged in a "criminal activity" so if a felon had a gun in the car this doesn't give him any coverage.

The law just says "person" who is not one of these 3 things:

(A) engaged in criminal activity, other than a
Class C misdemeanor that is a violation of a law or ordinance
regulating traffic;
(B) prohibited by law from possessing a firearm;
or
(C) a member of a criminal street gang, as
defined by Section 71.01.

I have always assumed that illegal aliens would not be covered by this since being here illegally is "engaged in criminal activity" but I don't know that for sure.

And it's not HB1815 anymore, it's law. Penal Code 46.02
