Unable to buy a gun

back 11 years ago in MI. I had been drinking and shooting my gun at my cottage deep in the woods a ex girl friend though I was going to shoot myself so she called the police. They came and took me drunk to a mental hospital for 3 days! I had to see a phyco. Dr for 6 months 1 hour a month and she cleared me and I was able to pick up my gun at the police station. I tried to buy a hand gun in LA. and found out I was flagged and was not able to buy it. What can I do???
 
Hopefully a member with a legal background will jump in. I have my opinion but unfortunately it's just that .
 
Flagged how? NICS or by California? If by California, your solution is to contact a lawyer to petition the court to reinstate your rights, or move to another state.

If by NICS, were you committed due to a court or magistrate's order? If not, then you should not have been "flagged" by NICS. ATF prohibitions: https://www.atf.gov/press/releases/2007/05/050907-openletter-state-attorneys-general.html

Best to get a lawyer to look into your specific issues.
 
I think the OP means LA (Lousiana) not L.A. (Los Angeles, California).

Yes, duanedecker is probably in the NICS data base either because of the treatment or because somewhere along the line there was another record of some kind. The answer is to consult an attorney. He can appeal the rejection and should be able to find out the reason. If it goes back to MI, he might have to hire an attorney in that state to check into the records.

Checkinng Records

Anyone can check their own records thanks the Freedom of Information Act...it dosn't require an attorney. Getting the problem squared-away may very well require one.

He can also contact the NICS and petition them from the reason for the hold or rejection.

Well, for starters I would not drink and go shooting/carry a gun. :uhoh:

As for your domestic violence/psych eval issue, Id consult a licensed atty or law firm in your area(not the World Wide Web or some law advice 1-800 #).

My state has a legal guide written by a lawyer with a active JD/law degree. He consults local media & is a authority on legal-private gun ownership issues.
A friend got a 2014 ed & praised it. I may buy the new E book format later.
 
The answer is to consult an attorney. Remember to give them all the facts, regardless of whether they're personally embarrassing or not.
