I just got my C&R and was wondering if any of the C&R folks on THR had ever had the ATF show up at your house. If so what was the experience like?
 
I'm nearing the end of my second cycle. (In other words, I'm on my first renewal.) The only time I ever hear from ATF is when they send out one of their generic "dealer newsletters." Despite the fact that 99% of it doesn't apply to C&R types.

I _really_ think the typical C&R holder is VERY unlikely to ever have to worry about ATF calling them. Unless you are buying and then selling really large numbers of guns. Then they will wonder if you are actually acting as a dealer. I haven't actually SOLD any of my C&R guns yet so I haven't had to worry about it!

If I remember correctly, if they decide to audit your records you have a say in whether it's done at your home or in their office. Of all the comments I've read on this, only a couple of people have ever had it done.
 
sorry for the brief sidetrack but if you have a C&R and you sell a gun is it the same procedure as a private sale or do you now have special things you need to do other then checking it out of some form of log book?
 
If you have a C&R and sell a C&R firearm to someone you need to record the disposition in your bound book. I always get their 03 FFL (if they're a collector) or full drivers license & contact info to put into the bound book.
 
I am a class 1 dealer and have been visited 3 times over about 25 yrs.They sent the same mean woman out each time sometimes with a trainee and they are not agents just employees .they have no guns or LEO status.Each time she found a thing or two to write me up on .Minor things. and she also randomly took info from 4473 forms and later called me and told me not to sell to a couple of people she had done checks on.this was before the background checks were in effect.
 
An ATF inspector visited me as part of the process of getting my C&R. She was very nice and just went over stuff. She said I could expect to see her every year, I have to wait and see if that happens.

visited last Friday!

I was visited by two ATF female agents from Baltimore last friday, and i have not even had my license for a year and have yet to purchase anything on it. They both had blue polo shirts and khaki pants on and atf badges and ID, they asked to see my license, and ended up staying for an hour an a half, asking questions, going through a long, prepared series of statements and even asking to see my non C&R guns:what: ..I should have said no, but i told em ok to that as well....They were very friendly but still, makes me think twice about renewing my permit....not worth the hassle imho....
 
Tosainu1, if they didn't give you 24 hours notice I would've told them to come back after they've followed proper procedure.

They are required to give you 24 hours notice, not just drop in on you. YOU have the choice of where the audit will be...either in your home or at THIER OFFICE.

If you do get notice that they're coming over for a peek, make sure you have all of your C&R firearms out - DO NOT let them poke around in your safe or look at any non-C&R firearms. Personally, I wouldn't let them anywhere near my safe.

They're not there for a social visit...remember that. NO WAY would they have seen my non-C&R firearms...NO WAY. That requires a warrant and without a warrant they can go fish in somebody elses pond. :fire:
 
I have the C&R

I can't say i ever had them show up, but as long as your records are up to date then you have nothing to worry about - there are a lot of government phobes and can make you paranoid - the only way they would show up is if you ordered 20 SKS's to you house or somthing

I wasn't aware that ATF is required to give you a 24hour notice. Would you be able to provide support to that?. I'm asking because if that is the case, they're trampling over lots and lots of dealers, including me. and, since they're willing to create heartache over the slightest transgression, I think it would be wise if they were transgressionless. :)

They did give prior notice, they left a note with the business card of one of the ATF agent in it. I then called her and scheduled the appointment at a convenient time for me almost a week later. Next time, they will not get a look at my non C&R guns. Cacique, where can you buy C&R guns in Georgia? I will be going to south east ga.(glynn county) and am looking for businesses that accept the license..thanks...

They are not required to give any notice. If they are going to inspect a collector, they will usually call first because collectors don't have business hours and want to be sure the collector will be available. Also, a collector has the option of having the inspection conducted at the nearest BATF office. Many people think that if they request the inspection at the BATF office, it will only involve records. This is not true. BATF can make you bring all the firearms you have listed in your bound book.
 
The home visits to C&R applicants, and recent licensees seem to only be happening in NY and the northeast US.

Many NY C&R holders also said that the ATF interviewer kept trying to ask questions as if they were an 01 FFL, and not a C&R 03. As if they're running from a script and didn't know the difference. I don't know if that's still the case recently.

I'd surmise it's one of three things:

1. A regional ATF director for the Northeastern US has this policy, or perhaps even just by oversight. (Like stating ALL FFL's need inspections, forgetting about the looser 03 requrments, and it's just never been recinded.)

2. New York City and other urban areas have the clout, or have somehow begged/pressured the ATF in to providing the additional oversight as they're constantly pointing fingers at blackmarket gun traffickers for their crime woes.

3. A C&R collector in the region actualy was acting as a black-market dealer, and it's resulted in the additional oversight.

Has any NY or New England area C&R collecter actualy had an ATF agent give them the straight skinny on why they do home visits there and nowhere else?
 
ATF New York Visit

I was visited by a nice young lady BATF(E) agent as part of my application process.

They do this because I live close to New York City, and so, am predisposed to be more violent and dangerous and irresponsible than folks living anywhere else. This is true, given the idiocy produced in that city, first by Giuliani’s robotic fascism, and now Bloomberg’s bizarre-o robotic knee-jerk pandering.

Other than that, I would bet on #3 from the list posted above......:cuss:
