I live in Illinois, the gun show is in Iowa. Tomorrow (Sunday) is the last day of the show. The standard waiting period is one day for IL, but does this still apply at a gun show? If it does, I'm wondering how I will pick up the gun if I buy one. The show is being put on by a local dealer, but will have many vendors.

First, you can only receive rifles/shotguns outside your state of residence from federally licensed dealers. No handguns may be transferred to you outside your state of residence from anyone.

If you choose to have a rifle transferred to you by a licensed dealer outside your state of residence, state laws of both your state of residence and the state the licensed dealer is located in must be followed. So, if you can get a dealer at the Iowa gun show to even transfer a rifle to you, an Illinois resident, both the state laws of Illinois and Iowa must be followed. If Illinois state law requires a waiting period, than the waiting period applies wherever you receive the rifle.

A handgun will have to be shipped to an Illinois FFL for transfer to you.

LY, where is it that you have to wait 1 day for a long gun? I've never had to wait any longer than it took for the Nics check and my credit card to clear.

Bought a Marlin rifle at a Wal-Mart in Iowa, Iowa doesn't have a waiting period for long guns, but according to them, Illinois law is one day.

In fact, on the website of the Illinois State Police it states, "Illinois law requires withholding the delivery of a concealable weapon (i.e. a handgun) for at least 72 hours and a rifle, shotgun, or other long gun for at least 24 hours. This applies for gun dealers and private sales."

Awful strange there. Never had to wait. In the 7 years I have lived here I've bought several long guns and never waited at all. And as far as implementing that to private sales, there is absolutely no way they could enforce that.

I agree about the private sales, but in the event that I find a decent deal at the gun show, it might be enforced.

Is this true? That would be depressing if it were. I was hoping to look for a handgun at the show tomorrow.

Here is something interesting. I live right on the border of IA/IL. The local store putting on the show has a store open in both IL and IA. If I did in fact buy a handgun, would I even have to have it transferred to a different FFL? On the basis that they have a store in IL, I wouldn't think so.

And what about the private sale of a handgun from someone out of state? Sorry about the multiple posts, thoughts keep coming up.

I believe some states require waiting periods and or NICS checks on long guns labeled "assault" rifles as defined by state statute.

Private transfer of both long guns and hand guns across state lines is federally prohibited under all but the most restricted of circumstances, such as inheritance or family transfers. I've had folks in neighboring states offer to buy guns from me FTF and to a man they didn't realize what they were asking me to do was illegal. I think maybe you could buy long guns out of state privately until the last decade or so????

You may buy a long gun from an FFL dealer in a contiguous state, but you can't buy a handgun from ANY dealer who doesn't reside in your state without arranging the transfer through a dealer in your state.

In the case of the private sale of a handgun, you can buy a handgun if you're under 21 through a private sale, but obviously not out of state because then they would have to transfer it to an FFL?

I would follow your dealer's advice and yes, you would probably be technically buying any new firearms in IL But all IL laws would apply. In the case of the show, a seller could simply walk the gun to your dealer's tables and you would pick the firearm up in IL as a legal sale even if you paid for the gun at the show. You would likely pay a transfer fee. Nice set up for the dealer.

The same could be done with a handgun from a private party. Essentially the IL dealer is transferring the gun to you legally the same as if the FFL or individual shipped the firearm to your IL dealer.

There is gunshop in AL that has a pawn shop in TN. You make the deal for a handgun in AL and pick up the gun in TN. But in this case, you would be paying TN sales tax because the sale actually happened in TN.
