Washington State SBR guffaw almost over

The governor got a bill on his desk to allow individuals to make their own SBR today. Previously the state and ATF had interpreted the law to ownership but not construction of SBR's by individuals. Assuming he signs it the smoke will clear.
 
You mean the same guy that signed the law allowing us to use silencers and allowed us to own SBR's? That guy? He might be a Democrat but he did more to expand NFA ownership in Washington than the last dozen governors.

The law allowing us to use silencers was signed into law by our previous governor (Christine Gregoire) in 2011. Governor Inslee has only been in office since 2013.
 
You guys in WA have any plan of action to help the Governor put his signature on this?
 
We are hoping it is buried under 10 tons of other crap. If he does nothing it will become law on April 1.

I plan to SBR a Sig MPX and would really like to do it on a Form 1 but, the new law doesn't take effect for 90 days, around July 1 or so. 41P is due to take effect in July which could muck up my Trust. I wonder if I should just pay the $125 cost to have a dealer "make" the SBR starting now on a Form 4 and be done with it, or wait for that small window of opportunity to Form 1 it in July?

Also, I wonder if ATF will accept an application for a WA Form 1 now, or will it have to wait the 90 days for the law to kick in?
 
Bikemutt, the 90-day clock started when the law passed on March 9th, not when it was signed by the Governor. Therefore it goes into effect on June 8th. So you have plenty of time to get Form 1 submissions postmarked before 41F.

I know of several people who are submitting Form 1s before June 8th; they figure that the ATF won't even look at their paperwork before that date. But that seems risky to me.
 
Yay. Now I can build an SBR . Oh wait, I have 5. In any case I was wanting to do one in one of those dedicated 9mm lowers that use Glock mags. Sweet.

Theohazard, I've run this past a couple "experts" who stick to their position that it becomes law 90 days after the governor signs the legislation, not 90 days after the legislature passes it. Are you certain about the timing?

Your "experts" appear to be mistaken.

Here's a thread on AR15.com started by one of the guys who helped draft the bill and push it through the legislature. He and others who were directly involved with the bill say the clock started when it passed, not when the Governor signed it. So it goes into effect 6/9/2016 (sorry, my previous count was off by a day.)

Here we go, I found a solid source on state-by-state bill effective dates:
Washington: Laws go into effect 90 days after the adjournment of the session, unless specified otherwise.

So it appears I misunderstood what they were saying in that AR15.com thread: A bill doesn't go into effect 90 days after it's passed, it goes into effect 90 days after the legislative session in which it's passed ends. The legislative session ended 3/10/16, so it goes into effect 90 days later on 6/9/2016.

I was confused because the bill was passed a day earlier on 3/9/2016, so I thought that was the day they were counting from. Oh well, at least I was only a day off. And either way, it appears your "experts" aren't experts at all. Tell them to do a quick Google search next time ;).

I guess we'll find out soon enough when the bill becomes effective, it'll either be at the end of the regular session or the extended session.

Either way, I decided to Form 4 my SBR this week, I think there's going to be a mad rush on Form 1s that may take ATF forever and a day to sort out. Meanwhile the 41P clock keeps ticking towards July 2015.

That was my way of rewording it. Either way, the session adjourned on 3/10/2016. So the bill goes into effect on 6/9/2016.
