What are the laws regarding firearm sales from a Washington resident to an Oregon resident?

I found a P220 that I'd like to buy for $450 but the guy lives in Washington.

Geez that really sucks. Are you positive? What if he comes across the border to Oregon and I purchase it here? Realistically, if someone lived 5 miles away from you across a river would you go through the trouble?

It is illegal to transfer a handgun to the resident of another state without going through an FFL.

Would I go through the trouble? ABSOLUTELY.

I did a deal with a guy in NC when I lived in Va. He delivered the gun I was getting to my FFl and I delivered the guy he was getting to his FFL. Saved us the shipping and was legal both with the Fed and the states.

What happens if you purchase a gun as a gift for someone in another state? I'm thinking of buying a HD firearm for my sister or giving her one of mine. Do I need to give her the money and let buy it herself?

From GCA, section 922

922. Unlawful acts
It shall be unlawful for any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) to transfer, sell, trade, give, transport, or deliver any firearm to any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) who the transferor knows or has reasonable cause to believe does not reside in (or if the person is a corporation or other business entity, does not maintain a place of business in) the State in which the transferor resides; except that this paragraph shall not apply to (A) the transfer, transportation, or delivery of a firearm made to carry out a bequest of a firearm to, or an acquisition by intestate succession of a firearm by, a person who is permitted to acquire or possess a firearm under the laws of the State of his residence, and (B) the loan or rental of a firearm to any person for temporary use for lawful sporting purposes;

Translation: You cannot give a firearm to someone out of state without going through an FFL. Don't ever, ever think it's "not worth the hassle." If there is one department of government that you don't want to mess with, it is the BATFE. Just ask Randy Weaver.

This is just the federal law. There are also (probably) applicable state laws that you will also have to comply with.

Thanks guys, that was a pretty stupid question to ask on my part. Today we're goin to the FFL to transfer my new P220 to me :D

Wow so I just spoke with the FFL I wanted to have it transferred through and he INSISTED that it's not true and that it'd be perfectly legal. It amazes me that an FFL holder doesn't know the laws and would give someone illegal advice. "Dude you're fine, you don't need to go through me." I'm still having the place do the transfer but they think I'm crazy and/or stupid.

which shop was it?

feel free to PM me, if you don't wanna post it, but for the interest of public safety, I wanna know what FFL can't read applicable laws.

The last thing I wanna do is run affoul of the BATFE.

Thanks!

I say post it.
