So, I score this CHERRY Marlin 336 .30-30 and have it sent to a local gunsmith to do all of the appropriate FFL paperwork. Gun arrives on the 13th of October. I call the shop and verify that the gun is there and he asked me if we have started the paperwork yet?:uhoh: No, we havent started the paperwork. He then tells me his FFL has expired.:banghead: How in the world did he have me send him a gun w/out a valid FFL? So, My gun has been there for almost 3 weeks collecting dust. Cant deer hunt with it cause, well Deer seasons over! *** can I do?
 
I'd see if he will bring it to another local dealer. He probably got the gun when his license was valid, and logged it in. He can't log it out to you because he is no longer a licensed dealer and can't run a NICS check, but he can (probably) log it out to another dealer who can transfer it to you.

It's important to try an always get a tracking number and track your packages. If you don't hear from a dealer/gunsmith within a day or so of arrival you should call them. Many guns arrive with no indication of who the new owner is, so the dealer can't contact you to let you know it came in.
 
he should have applied of an extension while he was processing his new application or if he was not planning on renewing then he should have never accepted from you to begin with.

sounds like he is not on the up and up to begin with. I would get the gun sent back to you or who ever it came from and also make sure to at least let the local BATF office know what is going on and made aware of the situation (they can actually be real helpful in giving the guy a courtesy call and getting the wheels moving).

So, he has gotten himself into a serious problem that will take a lot of cooperation with the BATFE to clear up -- and may result in some serious bad juju for him, at best.

And you want to jump in and share the misery by putting yourself into the middle of an illegal transfer? That has "Darwin Award Winner" written all over it.

Ask him what he's doing about it. If he doesn't give you a VERY good answer, tell him you're asking your local ATF office to look into the issue. If he's on the up&up, he's already dealing with them to clear the matter up. If not, make the call and get the ATF involved. Part of their job is administering these things. Let them work it out for you.

Just go down there, offer him $50, and pick up your rifle. Or, ask him to send to another local ffl holder.

Personally, I wouldn't pay him jack, because he provided -no- service.

The EX FFL should take the gun to another (in service) FFL to complete the sale/transfer.

If he is unwilling to do that, call the BATFE. They have absolutely no sense of humor on things like this.

In other words, let the Gummint and your gunsmith work it out, and keep yourself the heck out of the way!!! It's too bad that your rifle is tied up in the dispute, but that's life. You do NOT, repeat, NOT want the Feds on your tail.

You'll probably be given custody of your property, free & clear, some time before Hell freezes over.
