What is the legality of Repealing these Anti-2nd Amendment laws?

Rather than take on these anti-2nd amendment laws in the courts which could take years, if voters vote out all of these gun controllers and vote in 2nd amendment protecters, could they legally just repeal all of these anti-2nd amendment laws such as assault weapons bans, universal background checks, magazine limits, and such?


I know that the '94 AWB had a sunset, if these bans are similar can they legally be repealed before their sunset?

Not sure on the legality, but I think the majority of the country is for more gun control. All media outlets (with the exception of Fox) broadcast an anti-gun agenda in lock step with the liberals.

I vote, but I think unfortunate and inevitable changes are coming that will increasingly limit our 2nd Amendment rights.
 
US does not have a 'referendum' system for Federal law.

The recourse is either to get the law stayed by the Federal courts, or to elect new legislators who will submit a new bill to undo the earlier one.
 
Congress can always repeal a federal statute. A state legislature can always repeal a state statute. Repeal is just passing another law that takes an old law off the books.

All we need do is elect enough folks who would do that. We haven't had a whole lot of success on that score.
 
in the land of Congress, status quo is king. It's more difficult to repeal an existing law than to pass a new one (from a support point of view, not procedurally), regardless of how useless the old law is. It takes a lot of public pressure for most politicians to vote to repeal.
 
It seems that our best bet for getting rid of bad laws lies in the courts.
 
If you wait to elect congress criters that will repeal unconstitutional laws you will be waiting a very long time.....
 
Agree with General Geoff and Solo.

While we have had the Prohibition Amendment repealed following the abject failure of prohibition, repeal of bad law is more likely to be done by the court than by the legislature. For some reason legislators refuse to admit to mistakes, and that is what it takes to repeal bad law, an admission by legislators that they are fallible.

Yep, that would do it. There is one hangup, however: Politicians are fond of telling gunowners they support our Second Amendment rights; once in office they often stab us in the back.
