What's your take on Raich oral arguments?

So what is your take on how the USSC oral arguments went in Raich? I think this is going to be a pivotal case regarding state's rights and the limits on the powers of the federal government.

So what's your take? Is the USSC going to conclude that states have the right to control intrastate commerce within their own states, or are they going to cave to the "War on Drugs" and cannonize the federal government's power grab?

The optimist says, SCOTUS will side with the states.

The pessimist says, the Feds get to extend their power grab.




The realist says it doesn't matter, if SCOTUS goes with the states, Congress will just pass the law again with the phrase "because we find that drugs move in interstate commerce...."

Sorry, I must still be bitter over the last time they pulled that stunt.

I've got to agree with Flyboy's realist view.

It won't matter which way they decide, the Feds will keep the power, whether they are allowed to or not.

I think we're about to find out if the "federalism revolution" has any legs. My guess is the answer is no. Even Scalia was defending Wickard and drawing parallels to that case.

Pipsqueak, that's what scares me--from the little I've seen, it sounded to me, too, that Scalia was defending Wickard.

I am afraid that the whole concept of limited government no longer has "legs."
