Newsham said if anyone shows up to register a semi-automatic pistol that fits the city's definition of a machine gun, police will confiscate the illegal gun but will not immediately arrest the owner. He said police reserve the right to investigate and eventually charge such an owner with violating the machine-gun ban.

Not anything we don't already know, but I just think that it's absolutely ridiculous that the D.C. authorities would craft such ridiculous legislation classifying semi-autos as machine guns, and actually plan to charge people with a crime when the only ones violating the law is D.C.
 
Why not heller? His application was denied, he was trying to register a 7-round semi, most likely a 1911.

WASHINGTON (WUSA) -- District residents can start registering their guns today. But at least one very high profile application was already rejected.

Dick Heller is the man who brought the lawsuit against the District's 32-year-old ban on handguns. He was among the first in line Thursday morning to apply for a handgun permit.

But when he tried to register his semi-automatic weapon, he says he was rejected. He says his gun has seven bullet clip. Heller says the City Council legislation allows weapons with fewer than eleven bullets in the clip. A spokesman for the DC Police says the gun was a bottom-loading weapon, and according to their interpretation, all bottom-loading guns are outlawed because they are grouped with machine guns.

Besides obtaining paperwork to buy new handguns, residents also can register firearms they've had illegally under a 180-day amnesty period.

Though residents will be allowed to begin applying for handgun permits, city officials have said the entire process could take weeks or months.

By defining any semi auto that can use a magazine that holds more than 12 shots as a "machine gun."

(B) Semiautomatically, more than 12 shots without manual reloading.
 
I'd be surprised if Heller didn't re-file a suit. I hope many others join him. I hope the NRA, etc. jump on this too.

that the D. C. licensing law is permissible if it is not enforced arbitrarily
and capriciously, the Court assumes that a license will satisfy
his prayer for relief and does not address the licensing requirement.

I wonder how D.C. thinks they don't have an obligation to register Heller's weapon. They have been directed by the supreme court to do so. They are in direct violation of a court order.

Heller attempted to register a 9-shot High Standard Buntline .22LR revolver. He will be able to register it without a problem.
 
They are also trying to claim that ANY bottom feeding weapon is "grouped with machine guns" and therefore they do not have to register any bottom feeders. Well my answer would be to bring in a Sten or Owens. Gotta register it if it isn't a bottom feeder right?
 
I'm intrigued that the "amnesty" period involves handing in the handgun, which will be "ballistically fingerprinted", registered and returned ... what a great way to nail people with "thanks for meekly handing over your semi-auto, no you're not getting it back like you thought." Methinks that will (hopefully) spawn the appropriate suits.
 
The people running DC are insane and now, it would appear, are breaking the law. We get the government we deserve and the fools that voted for these people are seeing that old saw come to fruition.

I hope someone goes to court in a hurry.

I know this is a longshot, but since D.C. classifies semi-auto's as machine guns, maybe the ban will get struck down and machine gun ownership will be legal again. :p
 
Newsham, Fenty, DC police chief and cronies are showing total incompetence. Determined public defiance of instructions to them in a direct order from THE UNITED STATES SUPREME COURT.:what:
 
on the flip side, this could be a fantastic opportunity to get another positive and even further reaching ruling on the 2A by further defining what was left out of the SC's Maj-Op.
 
Based on the intent of the original law, I bet most of those allowed to own a gun will be white, wealthy, and/or former police or federal agents.

The whole purpose of the law was to prevent ["N-words"] from having guns, and the white establishment has not changed its mind on that, as the WP editorials well show.

Why can't these people realize that they have lost and give up already? It doesn't get much more clear than when the supreme court gives you an order to do something. :banghead:
