Would an AWB include AR upper parts?

Hey all,

I am seriously thinking of getting into the AR shooting world. Currently I only shoot pistols and shotguns.

My current thinking is to first get a complete rifle (maybe RRA Elite CAR A4), shoot it alot, learn all I can about its functionality and parts, and then build my own. I figure that the one that I build would be assembled with higher quality parts and result in a better finished product. I have no timetable on building my own, it could be a long while.

My question is, if a new AWB goes into effect, would AR parts be banned? Would uppers, barrels, triggers be included or just lowers? If it would just ban lowers, then I could see buying an extra stripped lower. But if it would include uppers and seperate parts then it doesn't make sense. At this time I don't have the money or knowledge to get the parts to build my own.

I'm sure it would ban kits and uppers though it would be harder to enforce as they don't need to go through an FFL unlike the lowers.
 
No one knows what an AWB would contain, if in fact one were to be passed, anymore than they could accurately predict what the stockmarket closing values will be a month from today.
 
If H.R. 1022 were passed tomorrow, it would also ban all parts that could be used to manufacture an "assault weapon" and those parts would be considered "assault weapons" in their own right under the law (only grandfathered pre-enactment parts allowed, no new manufacture).

Since an AR receiver is a "frame or receiver" that is specifically named. I would imagine the upper would be banned. The barrel might also be banned if it was threaded. The handguards would be banned because they fit the bill's definition of a "barrel shroud." The bolt carrier group and charging handle might still be OK.

Does that mean you would be able to buy used or older parts on gunbroker still? You mentioned no new manufacture.
 
I say no

the "Receiver" as far as BATFE is concerned is the lower receiver with the serial number.

Since new guns like the BlackStarArms non-AR15 do not use pistol grips, and the FAB-10 does not take detachable mags, and at least one AR lower is made to be single shot-only and uses no magazines, I would think an upper could reasonably be considered legal for use on those firearms.
 
Pilman... I have no idea. All the bill says is that "parts that can be used to make assault weapons = assault weapons." It doesn't say whether you need an FFL and a 4473 to transfer a set of handguards. All of that is left blank for ATF to fill in however they like.

Check out Section K-L of the bill defining "conversion kits" and "any other frame or receiver." The language is very broad. Maybe ATF would interpret that way, maybe they wouldn't. They might interpret it one way with a Republican in the White House and a different way with a Democrat there.

HR 1022 is a typical Politicians dream and citizens nightmare. They were quite specific about certain weapons they wanted to ban because they named them. However they didn't want to fall into the same "trap" that existed in
the 94 AWB. That ban listed specific items that if present in specific combinations (i.e. bayonet lug, pistol grip, detachable magazine etc.) would constitute an "assault weapon". In order for the antis to cover as many bases as possible and to rape as many gun owners as feasible they elected to put language in this bill that effectively bars any and all new "assault weapons" by banning the parts used to create them. This is intentional as they want to give the BATFEces as much leeway as possible to interpret the law with an eye towards banning as many different combinations of pieces as possible in the hopes of essentially eliminating as many new semi automatic weapons as possible. They painted this bill with the broadest brush possible so they could include as many different weapons and weapon types as possible. If stricly interpreted it could virtually ban any and all new rimfire or centerfire rifles that are semi automatic in function and could also affect some shotguns.
