Thank you all very much for your replies, both positive and negative (which I deserved). The situation has been resolved, and that's about as much as I can say about it. Looking forward to doing it right in the future with my son, my dog, and a better weapon than a bb gun. This truly is the high road, and i feel honored and humbled by your wisdom and patience regarding my ignorance.
 
A Father is the ultimate in authority when it comes to a boy/child. You realized wrong was done and conveyed that to the boy, however accidental that transpired. Personally, I'd a not involved other "authorities". good luck in all
 
According to our county game warden I can shoot anything I don't want on my property. He doesn't even care it it's an endangered species.

Call the game warden??..... You serious?

Your kid popped a quail with a pellet gun in your yard.......he's not out bagging and tagging truckloads of deer......tell him not to do it again and be done with it.

Calling the warden won't bring the bird back to life.....
 
As ignorance of the law is no excuse, I am calling a warden to have him confiscate the bird and explain the situation to my son.

That sounds like a terrible idea. You will get WAY more than him coming out and explaining the situation to your son. It's going to cost you a lot of money, and be a way bigger deal than you're thinking.

Just explain to your son that what you two did was against the law, and now that you are aware of it, it should never happen again. Then live your life.

In addition to being out of season, it is against the law to shoot upland game birds setting on the ground in most states.

The only legal method of hunting them is on the wing with a shotgun.

I had never heard of such a law. It is unethical, but I had never heard of any law that addresses it. I see Kansas does, so maybe that is common. Never gave it any thought before.
 
I ignorantly drove over the speed limit today. Went straight to the DPS and turned myself in. Kind of extreme eh? Don't get too wound up and go over board is the point here. No need to sour the boy's experience. Like the others have said.... learn a lesson, don't make the mistake again, and move on.

Check the laws in your state. In Florida quail, squirrel, rabbit, deer, and turkeys (in other words, almost any non-migratory game animal) may be taken by any legal method (rifle, bow, pistol, shotgun, falcon, etc.) during the season for that animal. There are more restrictions for some WMAs and for alligators.
 
You have the right to remain silent.

Exercise that right. Do not bust your son and yourself. You have learned your lesson. Let that be the end of it.
