Wow! My Dad just gave me his Grandfathers rifle! (papers? no papers? TX/CA?)

I had been storing a lot of tools for my dad while they were between homes with a garage.

My parents are staying with my sister while they are in escrow and since we are moving very soon, I moved the tools to my sisters house.

Just before I left, my dad says - hey that covers everything you were holding for me except for one thing. He said - I want you to have that rifle.

He inherited it from his grand father - may have been great grand father, have to ask again. Its a Winchester 63 - a semi auto, tube fed .22 with a little 2.5X scope and a leather scabbard. It is in very good condition. (I understand it can be quite valuable, but I would sooner sell a kidney).

Last time I had it out, I think the firing pin broke, but I plan to get it fixed. It shoots very well and my dad says when he was a boy, no squirrel was safe when he carried it.

Anyway, I have never inherited anything - especially a family heirloom and especially not a gun before! Dad is still here, for a long time God willing but man that made my day!

This gun is not "on paper" in any way and is legal, even in CA as such. However, I told him that I did not want it until I move to Texas because technically, in CA, I would have to have it transferred. I am assuming that it does not have to be papered if it is transferred to me when I get there.

Well, just thought I would convey this story. Some of you probably have inherited whole armories of guns - my great grandfather had a HUGE collection that was split among lots of relatives and he knew my dad always liked this gun and made sure it went to him. When I pass it to my son, it will be 5 generations. :D
 
Holy cow, if its been in your family a few generations, there probably isn't any paperwork for it at all as if it doesn't exist. I would keep it that way, no need for a papertrail if there is not a good reason for it. How long has it been a law in California that requires paperwork to be filled out to transfer the firearm? I'm not suggesting that you break or skirt the law, but you might have had that rifle for many years.

It is perfectly legal for your father to give you the rifle without going through a dealer for an official transfer. Transfers among members of an immediate family are exempt from that requirement by California Penal Code, Section 12078(c). Also, rifles do not have to be registered in California unless they are evil "assault rifles".

Now, get yourself a copy of Unintended Consequences by John Ross and, in addition to a reading a wonderful book, you'll learn a lot about your Model 63 and the various things that are possible with it. Hope you enjoy it for many years to come. I'm suitably jealous!
