Yet another NFA/SBR question

I have a 16" Bushmaster.

I wanted to know if I could just register the lower as an SBR (pay the fees, wait the wait, etc) and then some time later buy a short barrel upper, or do I have to have the buy the upper before I can get the paperwork through?

If I do have to buy the upper first, is it illegal for me to have a short barreled upper in the same house as my 16" or is it just illegal for me to put the parts together?

Also, if I do register the rifle as an SBR with an X" long barrel and later I buy an additional upper in Y" do I need to re-register it?

And lastly, if I go through this mess and then months later move to a new house (in the same state) do I have to re-register it?

It is best to only purchase the upper after you have the approved paperwork in hand. That way no one can accuse you of constructive possession.

I am no lawyer, but if it were me, I wouldn't have a short barreled upper in the same house unless I owned an AR pistol or had approved paperwork.

Once its registered, you don't need to re-register just because you change barrel lengths. What NFA branch recommends is writing them a letter to let them know the new length, both barrel and OAL. In practice, nobody really does this for an AR where uppers are swapped around so easily.

The only time you have to notify ATF that you are moving is if you will be transporting your SBR out of state. Once again, they recommend writing them a letter to let them know your new address, but there is no law I can find that requires it.

^^^ You want to fork over the difference between a semi AR and an M-16? If so, sign me up. Until then, I'll just swap out uppers on my SBR ;)
 
Better yet, get a machine gun receiver, and then you can put any length barrell on it you want.
For what a transferable full auto receiver would cost I could build 10 semi auto SBRs and have them registered :scrutiny:
 
I have heard of a lot of people putting as many barrel lengths as they'd want on the form, and some putting ranges (like 7"-14.5") although I think some of the ones with ranges got kicked back and told to put actual lengths.
I think if you have a SBR upper in your house without the lower registered for SBR yet it's kind of in that same area as having an auto sear without paperwork :uhoh:
Send in the form for a suppressor too cuz those shortys are LOUD! :evil:
