I have trouble understanding our due process. If a guy confesses to murder, how much process is he due? The guy said he did it. Why then do we have to spend millions on a trial? Just so the lawers and others involved can make money?

It is not unusual in high profile murder cases to have a number of different people all confess to the same crime. Before this phenomenon was discovered, undoubtedly a number of innocent men were hanged. Later arrest of the real murderer makes things absolutely untidy and embarrassing for the police.

Note...I dont agree with the way this article is being used by the website, but having done work in the feild, many of their conclusions are valid.

Look around you dude...is there a clear consensu in our society for things like the Rockefeller Laws, Three Strikes Youre Out, project Exile? Is there a national consensu on the death penalty...ya think we will, as a free society support amputation of hands, castration, torture. There's some good homework there, admittedly. Apparently:
Criminals are unimpressed with pre-determined lengthy prison terms,
American Proverbs JUST MIGHT have a credible application, and I have NO desire to be cutsie/sarcastic,
a national consensus for an individual crime's punishment is impossible.
Fine.
My ORIGINAL POSTULATION (as posted at falfiles.com) was that - If we changed the law in this circumstance to allow immediate family to determine punishment there should (I hate that word) be a cessation of these crimes.
(Even a contigency punishment should said family "forgive" the criminal)

Perhaps wishful thinking that such a dynamic sentence would allow this; I am not willing to throw up my hands just yet!! Besides, what we have now obviously isn't working, as you so credibly demonstrated!!
 
Did any of you guys catch Mark Lunsford (sp?) on TV? I saw him on Fox News, but it sounded like there were a bunch of reporters talking to him.

He started out thanking the media for all the support and help, then WENT OFF! He basically demanded that the governor, lawmakers, everyone get on board with making sure this kind of thing not happen again. Introduced some guy who had a bill calling for mandatory 50 year sentences for sexual predators, death for sexual predators who kill or commit 'heinous' crimes. Basically, it was a plea for Fla and the nation to create much, much stiffer sentences for these types of criminals.

It was incredible. I FINALLY saw pure, outright anger and indignation on TV about violent crime!

He took some questions and said Couey and all like him are scum and don't deserve to be among us, that he hopes the guy gets death and rots in hell, he said Couey should now stand up like a man and take his death sentence...etc.

Very refreshing. I was really impressed with the guy.

Hope the momentum carries long enough to see some changes to our laws...these creeps get off way too light. But of a broader view, there just isn't enough righteous indignation and moral outrage against violent crime anymore.

Just a bunch of cowards. We've become over-civilized. We can't even protect our own children in their own bedrooms. It's pathetic.

I'm not surprised nor do I expect the 5th amendment to be modified because of a worthless scumbag, but I'm dismayed someone hasn't killed this guilty creep yet.

Constitution or no constitution, we obviously can't rely on the justice system to help protect children.
 
Fox news reports that this peps lawyer is now saying that the guy was under the influence of some drug at the time. Someone is gonna try to get him off the charge or more likely get the sentence reduced...watching for more details.
 
For what it's worth here are my thoughts;

1. "He (the father) basically demanded that the governor, lawmakers, everyone get on board with making sure this kind of thing not happen again."

Where was the father the night his daughter was abducted? Why didn't he hear anything? He was staying the night at a friends house and didn't miss her until 6:00am when he came home to get ready for work. Is this adult behavior? Is this the way a responsible parent behaves? I am sick of parents being stupid and irresponsible, not doing their jobs with their famiiles and getting a pass when their kids get hurt. His daughter needed him that night and he wasn't there. It was his job to protect her from harm and he wasn't there when she needed him. Now she is dead after probably suffering horribly and he is partly responsible for creating a situation where she was vulnurable to this scumbag! What was going on at the friends house that was so important? You are going to learn that this little girl was targeted because she was an easy grab. Mr. Lundsford needs to demand more of himself first.

2. Everyone who hasn't worked in corrections or law enforcement needs to be careful when they tell us how we are doing it all wrong. You really sound stupid sometimes. Oz is not real. TV is entertainment, a good story, not reality. If you have all the answers, pick up a baton and walk the lines with us. We do the job you want done but don't want to pay for. We deal with the people you would rather pretend don't exist. Frankly, I'd rather you just said thank you and keep moving.

3. If you want Iranian justice, move to Iran. It is scary when an American can actually turn a serious thought to modeling our system after Irans. Maybe you forget that these people held Americans hostage for over 400 days in the seventies! They thought THAT was justice also.

It was reported this A.M. that this slug kept Jessica alive for 2 days after the abduction for his pleasure.
Give me 2 days with this animal, that seems fair.

So you would be saying that if something happened to mine or perhaps any of millions of families in this country, it would be the fault of the man in the family who works at night and not the pile of frog dung that committed the crime?
Are saying that some ordinary guy walking around who sees a kid playing in the backyard with their mother while the father leaves for work in the late afternoon, is going to say to themselves "It just occurred to me that I could break in this house, steal the child and rape him/her repeatedly, chop them up into pieces, and bury them in a shallow grave and maybe get away with it without being shot. By golly I think I'll do that."

Opportunity to commit a crime does not excuse the behavior of the criminal. Lets put the blame where it lies, shall we?

What? I hadn't read the part of her being home alone all night. Tough not to question that. If he was working- she's only 9y/o - Doesn't she need a sitter? If he was visiting a friend, I'd have to say he doesn't feel really good about himself right now. Regardless of any of that- it doesn't put all the blame on him. Fact is too many BG's seem to get off with too light a sentence. All the more reason to check the registered sex offenders list for your city and/or zip code. (hint: in FL, cities spelled with abbreviations, ex. St. vs. Saint, have two different listing results- I used zipcode instead.) It is ultimately up to the sheepdogs to watch thier own flock. Or deal with the guilt of failing to protect them. :( We don't seem to be getting help from a system that continues to err. :fire:Those on the list aren't the only BG's around us, it just helps to have all the info you can.

Correct me if I'm wrong, but didn't he and his daughter live with his parents? I would assume that his parents were in the house the night Jessica was abducted.
 
Hmm … Law of gravity still in effect, sun still shining, and yet I find myself agreeing with Wildalaska. :D

Anyway, the suspect’s confession, which appears to be legitimate, should make a conviction fairly easy. However, he still enjoys the legal presumption of innocence and the right to a fair trial. I expect he will plead guilty to charges that avoid a death sentence.

Borderline topic anyway, and I'd say after four pages it's become obvious that babysitting it is more trouble than it's worth.

Thanks to those of you who contributed and avoided antagonizing people.
